LONDON — In an unprecedented, wide-ranging interview with British financial newspaper City A.M., OnlyFans’ CEO Ami Gan stated that the company she leads is an “ally” of the U.K.’s controversial Online Safety Bill.

The proposed piece of legislation, unveiled by the Boris Johnson government amidst a moral panic about “the harms of pornography” propelled by the press, has been criticized by digital rights advocates as a state attempt to censor free speech.

As XBIZ reported in late March, when the conservative government unveiled their proposed draft, the Johnson ministers focused on “pornography” as the main supposed “online harm, claiming their bill “will protect children from harmful content such as pornography and limit people’s exposure to illegal content, while protecting freedom of speech.”

The lengthy announcement about the proposed legislation declared that the bill’s main mission is for “Parliament to approve what types of ‘legal but harmful’ content platforms must tackle.”

The U.K. is a “constitutional monarchy” with no written constitution, bill of rights, First Amendment or codified Section 230 protection for the monarch’s subjects.

Online moderation and digital rights experts told the BBC’s “Science Focus” magazine in April about a multitude of concerns around giving the politically-appointed staff at communications regulator Ofcom, “the power to govern what we say online.”

Rebranding OnlyFans as a Financial ‘Success Story’

In an attempt to rebrand OnlyFans as a financial establishment-friendly “success story,” Gan told City A.M. that the platform is “proof that online safety, freedom of expression and being a successful business can coexist.”

According to the article, Gan also criticized “fellow social media firms who claim this holy trinity is unattainable.”

The City A.M. reported described Gan —  the former OnlyFans publicist who suddenly took over from previous CEO Tim Stokely in December — as “a fresh face for a company that is synonymous with adult content” and “a distinct shift from the man The Sunday Times dubbed as ‘the king of homemade porn.’”

Gan told City A.M. her company is “a leader in online safety” and “pushed back against allegations that the platform has failed to prevent underage users from selling and appearing in explicit videos.”

Gan told the financial publication that the notorious incident last year when the company announced it was eliminating adult creators, only to backtrack after a grassroots campaign by sex workers, was a learning experience that “showed the ‘power of the community’ for the company and affirmed creator-first direction they needed to be taking.”

Gan added OnlyFans is “very proud” of “its glamour and adult content community, and confirmed it was something that won’t be going anywhere any time soon.”

South Carolina House Quietly Kills ‘Library Porn’ Budget Proviso

COLUMBIA, S.C. — The South Carolina House quietly declined to support the so called “library-porn proviso,” a budget mandate that had been approved by the State Senate in March and which enshrined a category of “any books or materials that appeal to the prurient interest.”

As an editorial by the influential Post and Courier newspaper calling the proviso “unnecessary” explained, the first version of the amendment introduced by state senator and Christian talk show host Josh Kimbrell (R) actually “came close” to outright calling for state censorship, “prohibiting libraries from having ‘any books or materials that could be harmful to children or that appeals to the prurient interest.’”

The version that the Senate adopted in March and which died in the House last Friday, the paper continued, “removed the breathtakingly broad ‘harmful to children’ language — which could include books about, say, grilling out — and doesn’t require libraries to remove any books. It simply means some books may have to be moved from the children’s sections of county libraries to a special parental section or the general circulation area.”

The House also declined to move forward with what the Post and Courier described as “the next-closest cultural flashpoint,” a requirement for high schools “to post assigned reading lists online by the 15th day of each semester,” which was “a pared-way-down version of the so-called anti-critical-race-theory legislation.”

According to the report, the “library-porn” proviso “set off an outrage when the Senate approved it back in March.”

“We might get to see some performance art on Wednesday, as senators complain about those liberal House members who refused to go along with their restrictions,” the Post and Courier noted, “but after Friday’s votes, this show is over for the year.”

The May editorial by the same paper criticizing the vague, censorious language proposed by the Christian disc jockey and politician spelled out that the proviso’s “lack of clarity is the result of trying to prevent children from seeing things you don’t want them to see by using language that’s designed to protect them against sexual predators who have clearly developed prurient interests.”

Most young children, the editors continued, “haven’t yet developed ‘prurient interests’ to be aroused; what they have is interest in unfamiliar material that their parents not unreasonably think they’re not old enough to learn about.

“If there’s a problem that needs fixing, lawmakers need to provide some clarity about what the problem is — Is it ‘sexually explicit’ material that Sen. Kimbrell told the Senate he was targeting? Is it nudity? Is it pictures that involve sexual activity? Is it written descriptions of sex?”

The editorial board even urged lawmakers, if they really meant what they implied, to curtail the chilling effect on free speech of these moral-political stunts by writing down “a definition so librarians don’t have to wonder if descriptions of sexual immorality in the Bible are covered.”

Spanish Legislators Move Forward With Proposal to Re-Criminalize All Sex Work

MADRID — Spain’s Congress of Deputies moved forward Tuesday with a proposed new law backed by the ruling party, aiming to “prohibit pimping in all its forms” with the final aim to “abolish prostitution.”

As XBIZ reported, the bill introduced May 19 aims to outlaw all sex work, including all sexual performance deemed to be “pornographic.” The legislation moved forward this week with 232 votes in favor, 38 against and 69 abstentions.

The ruling Spanish Socialist Workers’ Party, or PSOE, introduced the proposal as “an abolitionist law against sexual exploitation,” something that had been included in the party’s platform.

The draft includes Section 187, which explicitly outlaws audiovisual productions, magazines or internet content deemed “pornographic.”

Prominent European feminist adult industry figures Erika Lust and Paulita Pappel expressed dismay about the PSOE attack on all forms of sex work.

Prime Minister Pedro Sánchez has actively campaigned for “the abolition of prostitution,” including during the most recent PSOE convention, in Valencia last October.

Other prominent politicians within PSOE, which took power in 2019 after several years of conservative rule under the Partido Popular, have taken up the abolition of sex work as their personal cause. These include the party’s General Vice-Secretary Adriana Lastra, who last month took to the press to promote the change in the Spanish penal code to mandate up to three years of jail time for anyone paying for sex.

“We must abolish prostitution because it is incompatible with human rights,” added the spokesperson for the PSOE’s Equality Commission, Laura Berja.

Lastra framed the effort as an attempt to reach out to the right, saying she hoped both the conservative PP and the left-wing minority alliance, Unidas Podemos, would vote for it.

Reviving Franco-Era Policing of ‘Pimping’ and ‘Brothel Keeping’

The proposed legislation would revive the crimes of “proxenetismo,” meaning pimping or pandering, and “tercería locativa,” or brothel-keeping. Both were removed from the penal code in 1995 by a previous PSOE administration.

The language in the bill exclusively uses the Spanish feminine “prostituta,” which is both stigmatizing and criminalizing, and also essentializes sex work as a female occupation. The law also conflates legal minors with the much vaguer “persons in situation of vulnerability,” which could be deployed by authorities to apply to whomever they wish.

Feminist reporter Noemí López Trujillo pointed out several specific technical issues with the draft, which would involve law enforcement in consensual commercial sex to a degree not seen in Spain since the Francisco Franco dictatorship and its Political-Social Police Brigade.

López Trujillo consulted with several legal experts, who confirmed that “proxenetism” or pimping is already penalized in Spain, as long as it is tied to exploitation. The new law will expand the definition to include any kind of aid or support to sex workers, regardless of exploitation or consent.

“Although the introduction to the law claims that relatives of sex workers will not be prosecuted,” López Trujillo noted on Twitter, “the legal definition as drafted says nothing about it.” 

“If anyone lives off of the income of the ‘person in situation of prostitution,’ it is understood that there may be a profit motive,” she explained, adding that if such a third party knows about what kind of work the person does, “t can be interpreted that they are enabling it or promoting it.” 

Legal Experts Point Out Dangers of Re-Criminalization

López Trujillo’s article for the Newtral news site provided an in-depth analysis of issues with the law, which establishes a souped-up version of the Nordic Model and goes against the wishes of most active sex workers and sex work advocacy groups, which were not consulted by the PSOE’s anti-sex-work activists.

A central issue with the law is its interpretation of “tercería locativa,” which establishes criminal liability for any third-party location that the state would consider is functioning as a brothel.

López Trujillo spoke with Miren Ortubay, law professor at the Universidad del País Vasco, who pointed out that “when a type of crime is so broad, you dilute the legal certainty,” and leave the enforcement to the “ideological biases of those doing the judging,” particularly racism and classism.

“If it is a cop who is taking advantage, somehow, of a woman prostituting herself,” Ortubay, a criminologist and penalist, explained, “the judge most likely won’t consider him a pimp. But if it’s a foreigner, the biases will increase the possibility that he will be considered ‘a pimp,’ even if the behavior is the same.”

Inés Olaizola, a penal law academic at the Universidad Pública de Navarra, added that the PSOE proposal “takes agency out of the consent of the women who work as prostitutes.”

By classifying all prostitution as “exploitation” — and thus erasing sex workers’ ability to consent — the proposed law essentially treats women “like minors,” Olaizola explained.

New Japanese Law Would Enable All Porn Performers to Void Contracts

TOKYO — A legislative debate about lowering the age of legal majority in Japan, which quickly devolved into a sensationalist campaign about adult performers aged 18-19, has now morphed into a proposed new law under which anyone who signs a contract to appear in “pornographic productions” could void that contract at any time for any reason.

Today, Japanese newspaper The Mainichi published a lengthy, sensational account allegedly based on two anonymous women’s experiences in the Japanese adult industry, immediately followed by a tacit endorsement of the curious law that would render any “pornographic production” contract essentially unenforceable.

“As Japan’s parliament debates a new law drafted to protect young people who signed contracts to perform in pornographic productions, two women have spoken out about the abuses they suffered in the shady industry, hoping the legislation will be a ‘first step’ toward ending exploitation,” the Mainichi report began, before going into a detailed description of the two anonymous performers’ alleged experiences.

The report did not identify any specific companies or directors behind the accounts of labor and sexual abuses.

The newspaper then extolled the bill proposed by “a bipartisan group of lawmakers” which not only allows people who agree to appear in “pornographic content” to terminate their contracts, but also requires “video vendors” in such cases to “recover the products and delete the footage.”

Mainichi explained that this novel law “also mandates that a month must pass between the signing of the contract and the filming of the video, and four months between the filming of the video and its public release.”

The original debate concerned amending a law lowering the age of majority by extending additional contract protections specifically to adult performers under 20 years of age. However, this led to a bait-and-switch, which the newspaper candidly spells out in describing this new, universally applicable law: “Although it targets people who appear in porn regardless of age or gender, the lawmakers came up with the bill after Japan lowered the age of adulthood in April, making it no longer possible for 18- and 19-year-olds to cancel contracts to which they have agreed.”

As XBIZ reported, the age-majority bill was passed unanimously in a plenary session of the House of Representatives in late May. Japan’s higher chamber, the House of Councillors, has to deliberate on it before a likely enactment this month.

LONDON — LELO is reportedly exploring a sale, according to a Bloomberg report published yesterday.

According to Bloomberg’s analysts and sources, the Sweden-based sex toy company is exploring the sale due to a very favorable valuation that takes into consideration that the pleasure product industry “experienced a boom during the coronavirus lockdowns.”

LELO is currently partially owned by Chinese buyout firm Trustar Capital and has “attracted takeover interest from corporate suitors as well as private equity funds,” the report explained. 

An earlier plan for an initial public offering (IPO) in London was scrapped. Bloomberg reported last September that LELO was seeking a valuation of more than £1 billion ($1.3 billion) then.

According to the tech news service, the global sexual wellbeing market has been projected to double to more than $62.3 billion in revenue by 2030.

This is due, a financial research group noted, to “the declining stigmas around the products.”
