MIAMI — Gia Derza plays a horror movie fan who is up late and alone, watching scary movies, when she receives an unexpected visitor in the latest release from DickDrainers.

“This one was a long time coming and certainly worth the wait,” said costar and DickDrainers principal Branden Richards. “Gia is a joy to have on set, such great energy and an amazing performer. ‘Anal Queen’ is a title she earned in this one. Derza said it was “one of the most hardcore, fun scenes” she has shot.

PARIS — New details about the French media regulator plan to block all the major free adult sites in the country over a controversial age verification law surfaced today during a discussion held in the French Senate.

One senator proposed treating consensual, legal adult content “like terrorism or pedophilia.”

Representatives of ARCOM, a recently-formed agency that superseded former regulatory agency CSA, an analog of the American FCC, explained that due to a procedural error by their lawyers, a hearing scheduled for May 24 to decide whether to block Pornhub, xHamster, XNXX, Tufik and XVideos had to be postponed until Sept. 6.

It was also revealed that politicians had also “considered the curious idea of replacing the homepage of ‘porn sites’ with a black screen to verify ages,” Marc Rees, of French tech news site Next INpact, reported today. Rees is the main journalist tracking ongoing threats by the Emmanuel Macron government to censor many of the most popular adult tube sites.

Several French senators proposed a number of theoretical ideas to verify age in absolute ignorance of longstanding debates about age verification and content moderation, with the ARCOM regulators having to patiently explain why they were impractical or illegal.

The Aftermath of a Controversial Law

As XBIZ reported, France’s age-verification mandate was surreptitiously added to a hastily approved domestic violence law during an atypical and sparsely attended COVID-era session of the French Parliament in July 2020.

The law specifies that adult companies should be required to institute measures beyond simply asking an internet user whether they are of age. It also empowers a government official — the president of ARCOM — to demand that the president of the judicial court order the ISP providers to immediately block infringing sites in the entire country.

According to Rees, Pornhub is in the process of filing a challenge to the controversial law’s constitutionality, based on the legislators’ vagueness while drafting it, which violates the legal principle of “freedom of expression and communication.”

ARCOM’s General Director Guillaume Blanchot also explained that his regulatory agency was also now bound by external “procedural constraints” due to France’s membership in the EU.

“Because of the application of the ‘country of origin’ principle, which is enshrined in the ecommerce directive,” Blanchot noted, “we must not only inform the Member State where most of the sites are established of the procedure we are undertaking, and ask them whether they intend to take action against them itself; but also, at the same time, we must inform the European Commission.”

This is, therefore, “a procedure that requires a number of information guarantees and procedures, which make it longer than we could wish,” he added.

Senator: Treat Porn Like ‘Terrorism’ and ‘Pedophilia’

According to Rees’ reporting, during the senate round table, VP of the Senate Laurence Rossignol floated the idea of “treating pornographic sites as pedophile sites or sites that glorify terrorism” in order to implement “an administrative blockage, without the intervention of the judge.”

Blanchot then clarified for the senator that while terrorism and pedophilia are illegal in all cases, pornography is most certainly not for adults.

The confessedly tech-ignorant senators also suggested a vague scheme of “replacing the home pages of XXX sites with a black screen, until the internet user presents a bank card to pay for this access.”

The ARCOM representative pointed out that “it is not possible to force porn sites to set up paid default access,” or for the state to mandate that their business model be exclusively paywalled paysites.

AMSTERDAM — OnlyFans’ Chief Financial Officer revealed today that he had “underestimated the strength” of OnlyFans’ adult creator community during the controversy caused by the platform’s 2021 decision, later reversed, to ban adult content.

OnlyFans’ CFO’s Lee Taylor made the unusually candid comments during the Money 20/20 fintech conference in Amsterdam, as CNBC reported today.

“It was obviously a challenging time,” Taylor added. “The thing I’m proud of the most is how quickly we were able to reverse it.”

The original decision to ban adult content prompted “an uproar from creators and sex workers who had come to rely on it as a source of income,” Bloomberg wrote at the time, and “was forced in part because of pressure from ‘banking and payment services.'”

Keily Blair, OnlyFans’ chief strategy and operations officer, told the financial sector conference attendees that OnlyFans has continued to grow “with its team increasing 2% to 3% each month.”

“We are aware of the cost of living crisis,” Taylor explained. “We are building a team in the U.K. to help our creators maximize their earnings.”

Blair also noted that unlike other pandemic-era economic success stories (e.g., Netflix), OnlyFans is not experiencing a slowdown in subscribers.

Although the CNBC reported remarked that “OnlyFans isn’t exactly a name you’d associated with fintech,” adult industry observers have long identified the company’s main strength as a middleman for payments.

The platform, the CNBC report noted, “has sought to branch out into other areas of content beyond porn, an industry that has had an awkward relationship with the mainstream financial world.”

The report did not mention how that supposed “awkwardness” was directly connected to religiously inspired anti-porn crusading lobbies like NCOSE and Exodus Cry, or their mainstream media mouthpieces like Nicholas Kristof.

VADODARA, India — An official with India’s Cybercrime Police agency admitted this weekend to the press an upsurge of people being successfully blackmailed by criminals for watching adult content websites because of the “illegality” of doing so according to local laws.

Leading establishment newspaper the Times of India reported on the trend on Saturday, shaming the victims with a debunked pseudomedical description, headlining it “Porn Addicts Getting Threats of Extortion in Vadodara.”

According to the newspaper, several victims of fraud — some of them elderly — were contacted via a phone pop-up while visiting an adult website.

The pop-up mimicked an official government ministry supposedly tasked with monitoring online activity for violations of India’s expansive obscenity laws.

“It read that surfing porn websites is illegal and [the victim’s] details have been noted by the union home ministry,” the report explained. “He was asked to pay a certain amount to avoid getting penalized and prevent his details from getting public.”

A cybercrime police official confirmed to the newspaper that the existence of the porn ban is what helps the blackmailers be successful.

“There have been instances of people being blackmailed by citing illegality of watching porn websites,” the official noted. “The frauds [i.e., extortionists] make websites that are very similar to the authentic government sites and the language they use is so convincing that victims end up paying money.”

A Flood of Fraud Victims

The paper mentioned that “ethical hackers and cyber experts are getting flooded” with requests from fraud victims attempting to combat this threat to their reputation.

The experts noted a multitude of requests from Vadodara, Ahmedaad and Surat in the last few months “where the surfers have either been duped of money or blackmailed.”

Cyber expert Mayur Bhusawalkar said that victims find it “too embarrassing to admit to the cops that they surfed porn websites.”

The criminals are emboldened by the victims’ belief that “filing a police complaint would mean that his family would also learn about it.

“In fact, most victims don’t want to file a police complaint,” Bhusawalkar told the Times of India.

Last week, as XBIZ reported, India’s increasingly powerful Ministry of Electronics and Information Technology (MeitY) published proposed new rules that would give the government sweeping control over social media platforms like Twitter and Reddit, digital news publications and streaming sites — including the power to punish them for “porn” and “obscenity.”

India is currently in the middle of a media-driven “porn panic” centered around reporting on a case involving Bollywood celebrities who invested in an X-rated online startup.

LA Direct’s License Renewed, With 4-Month Suspension

SACRAMENTO, Calif. — A judge at the California Office of Administrative Hearings issued a decision in the long-standing licensing case concerning LA Direct Models, renewing the agency’s license but also placing it under a four-month suspension.

Administrative Law Judge (ALJ) Eric Sawyer ordered the renewal of LA Direct’s California license, which had been challenged by the Labor Commission in 2018 after allegations against the agency and owner Derek Hay surfaced in a separate labor board dispute with former clients, the so-called “Jane Does” case.

Since that challenge, LA Direct has been operating in California with periodically renewed “temporary licenses.”

Concurrent with the renewal, ALJ Sawyer also decided that LA Direct’s license “shall be immediately suspended for four months.”

Hay was also ordered to review his business practices based on testimony provided during the license hearings, with Sawyer specifying the agent “shall be prohibited from referring clients to businesses engaged in escorting; having clients sign contracts, fee schedules, or similar documents, that have not been approved by the Labor Commissioner; charging clients kill fees or cancellation fees unless and until such fees are contained in a contract approved by the Labor Commissioner; collecting rent or other debts owed to Derek Hay or any other individual; and sending clients to assignments which respondent or its staff know or reasonably should know are hazardous to clients’ health, safety, or welfare.”

The judge wrote that “cause exists for discipline” of LA Direct’s license because the Labor Commissioner — represented by attorney Barton L. Jacka — “established by a preponderance of the evidence that respondent violated provisions” of the Talent Agency Act.

The violations cited by the judge included: “using contracts not approved by the Labor Commissioner, improperly withholding client funds, sending clients to hazardous work assignments and knowingly permitting persons of bad character to frequent its business.”

The decision also stated that “Mr. Hay is a person of bad character (for purposes of this statute) by virtue of referring clients” to an alleged escorting agency, but also that “Mr. Hay did not coerce or request his clients to participate in the escort business.”

The outdated “character” assessment language in section 1700.35 of the California Talent Agency Act dates from 1913, and states that “no talent agency shall knowingly permit any persons of bad character, prostitutes, gamblers, intoxicated persons, or procurers to frequent, or be employed in, the place of business of the talent agency.”

“In sum,” the judge concluded, LA Direct and Hay “harmed clients, but not so severely as to warrant outright revocation of respondent’s license in and of itself.”

Sawyer wrote that such a revocation “would be overly harsh and punitive” because Hay “is well-regarded by many in the adult entertainment industry and has been generally honest and straight-forward when working with clients and others in the business” and therefore he “is capable of understanding his wrongdoing, once so advised, and that he has the business acumen to correct it.”

The four-month suspension, Sawyer decided, should “provide sufficient time for Mr. Hay to recalibrate his attitude and respondent’s business practices.”

The suspension will also allow LA Direct’s current clients “to terminate their exclusive relationships with respondent, if they so choose, once they discover the violations established in this case.”

The decision is dated April 20, 2022 but was only made public over the weekend.

LA Direct Responds

“Under California law,” an LA Direct rep commented in reaction to the publication of the decision, the Division of Labor Standards Enforcement (DLSE) will have three months to consider its options on the decision, including whether to accept or reject, or whether to allow it to be adopted by operation of law, as it did recently in a separate temporary licensing case Direct Models initiated and won.”

The rep noted that the development, however would still not end the disputes between Direct Models and DLSE, “as Direct Models has a pending claim for damages against DLSE as well as a separate lawsuit for damages filed in the Los Angeles Superior Court for DLSE abuses against Direct Models.”

Direct Models’ attorney Richard Freeman commented that while he views “some of the conclusions and findings through a different lens than ALJ Sawyer,” he agrees with the decision that “the proposed ‘punishment’ of four months suspension, not license denial or revocation, [is] much more appropriate for what he found to be proven.”

Direct Models filed a separate lawsuit for damages in the Los Angeles Superior Court in April, alleging DLSE abuses against the agency. The complaint alleges “Intentional Interference with Prospective Economic Advantage, Abuse of Process, and Intentional Infliction of Emotional Distress arising from their intentional abuse of discretion in refusing to continue issuing Provisional Talent Agent Act Licenses to Direct Models on April 23, 2021, while the licensing action it had initiated was still pending.”
