FSC Publishes Guidance on Google Analytics Lawsuits

LOS ANGELES — The Free Speech Coalition (FSC) has published guidance on how adult websites can protect themselves in the wake of several consumer class action lawsuits filed against sites for using Google Analytics.

[S]everal adult industry companies have been targeted by consumer class action lawsuits for allegedly violating the Video Privacy Protection Act (VPPA) by using Google Analytics on their websites. This article will give an overview of what the law is, the lawsuits that have been filed, and what your company can do to avoid becoming a target. This information is provided for educational purposes only and does not constitute legal advice.

What is the VPPA?

The VPPA is a U.S. federal law that was enacted in 1988 after Supreme Court nominee Robert Bork’s video rental records were published in a newspaper without his consent. It prohibits companies from sharing information about the videos a consumer has watched if it’s combined with personally identifiable information about the person without their consent.

In practice, this means that you must get the user’s consent if you transmit data to a third party that includes information about the user (name, email address, IP address, customer ID, device ID, etc.) and the video (title, description, subject matter). The law explicitly requires “informed, written consent” collected separately from any other legal or financial agreements. The website must also provide, in a “clear and conspicuous manner,” the opportunity for the “consumer to withdraw [consent] on a case-by-case basis or to withdraw from ongoing disclosures.”

The law authorizes class action lawsuits against violators for actual damages starting at $2,500 per person as well as punitive damages to punish the company.

What the Lawsuits Allege

According to the American Bar Association, there’s been a flood of VPPA litigation since 2022 against all manner of websites using marketing tools like Meta pixels and Google Analytics. In the recent cases against adult companies, the plaintiffs filed cookie-cutter complaints alleging that the targeted website “collects and transmits information related to individuals’ use of the Website, including the specific pornographic videos that they watch (the “Sensitive Information”), to third party advertisers, including Alphabet Inc. (“Google”), through the use of surreptitious online tracking tools.”

In addition to the VPPA allegations, the plaintiffs tack on an assortment of related claims:

  • invasion of privacy
  • negligence
  • breach of implied contract
  • unjust enrichment
  • violations of federal and California privacy laws
  • violations of New York and California business laws

How Companies Can Protect Themselves

[T]he law firms bringing these suits are actively seeking adult website subscribers to join their cases or file new ones. If your website engages in the “rental,

sale, or delivery of prerecorded…audio visual materials” and transmits data about the videos your customers are browsing or watching, you should be concerned.

While there is no way to guarantee that your company will not be targeted, experts at the ABA and IAB recommend limiting your risk by ensuring that you have your customers’ consent prior to sharing their data with third parties.

According to the law, you must obtain “informed, written consent (including through an electronic means using the Internet)” that is “in a form distinct and separate from any form setting forth other legal or financial obligations of the consumer” – i.e., it cannot simply be incorporated into your site’s privacy policy or terms of service.

The law requires that consent must be able to be withdrawn and must be reaffirmed at least every two years. Experts recommend that if you are going to obtain consent (rather than discontinuing use of third party data sharing), you must have a way to record the time and date it was given and automate verification after 24 months.

If you don’t want to manage it yourself, there are a variety of products available to help sites comply with the VPPA, GDPR, and other laws – including tools that integrate with Google Analytics and at least one free option.

But it’s really fun to be versatile.”

That versatility is a big part of why she has gained such a solid fan base, one that’s followed her across platforms. Vodka chats with fans all day across multiple platforms, and doesn’t take those relationships for granted.

“It’s really important to me,” she says. “You’ve got to have a strong connection with the people who support you. Starting as a cam girl, that is your lifeline. Those people love you because they talk to you.

“They get to know your personality on top of, you know, showing hole,” she laughs. “That’s kind of what I built my brand on: being really easy to talk to and relatable, just a ‘real’ girl.”

Some of Vodka’s longtime fans from her Chaturbate days have followed her every step of the way, but making the jump into studio porn also opened the door to an entirely new audience.

“People who love a cam model, love a cam model,” she says. “They like the experience of feeling like she’s just in her room — it’s more personal. Though it depends. There are fans who watch cams because they love porn, so sometimes it overlaps.”

On set, Vodka brings a distinct kind of fire. She says her favorite part of performing is tapping into a different persona, the part of her that comes alive when the camera starts rolling.

“It feels like a different part of myself every time,” she says. “I love the energy I get to bring. It’s a really fun, exciting energy exchange and release.”

That switch flips fast, too.

“It’s so strange,” she reflects. “Everything just kind of goes blank when I get to set. I could be having the worst day of my life and then I’m like, ‘No, you’ve got to turn it on.’ And I do.”

Vodka has recently started pushing into new territory, including her first gangbang, which she describes as “really fun.” She did it with four other performers, but is already looking forward to more.

“I wish I could just gangbang everyone all at once because there are so many great performers,” she laughs. “I’d also love to do more BDSM stuff. And I really want to do more acting. I want to be in a feature, a showcase — all that fun stuff.”

As much as she brings a powerhouse energy to set, Vodka’s off-camera life is surprisingly chill. A Florida native, she grew up loving sunshine and sand.

“If I still lived in Florida, I’d definitely be at the beach on a perfect day off,” she says. “Anything outside, anything in the sun — that’s my favorite thing. I love to run and go to the beach. I love to tan.”

And when she’s not working, running or jetting to a shoot?

“I’m honestly a pretty big nerd,” she confesses. “Sometimes that surprises people, but I love reading, scrapbooking and other nerdy little things.”

Vodka points to the impressive collection of books behind her, a wall that looks more like a mini library or a cozy indie bookstore.

“I like to read everything,” she says. “I have cheesy romance novels, political books, philosophy… just everything.”

Her personal and professional goals are tightly woven together these days: Keep pushing herself, keep creating.

“I want to continue making things that excite people,” she says. “I want to work with more studios and just level up in every way. Maybe even win some awards?”

Right now, Vodka is prepping for a major content trip for which she’s got some pretty ambitious scenes lined up.

“I’m going to Europe and shooting some pretty crazy stuff,” she teases. “Some more gangbangs, and I’m finally doing a triple vag. Anal is also coming up later in the year.”

After intense scenes like the ones she has planned, most performers find aftercare to be essential. Vodka, however, tends to keep it low-key.

“After my first gangbang, I was just so stoked that I didn’t really need anything,” she says with a grin. “But if it’s something super intense, I just take care of myself — grab some good food, kick back, chill out.”

For anyone looking to follow in her footsteps, Vodka offers advice that is simple, raw and real.

“The industry is definitely competitive now,” she says. “With social media and so many people doing it, you’ve really got to bring something extra. You’ve got to put your personality into it.”

Coming from someone who built her brand on being both relatable and relentlessly real, it’s the kind of advice that lands like a pep talk from the hot older sister you wish you had.

“If it’s what you want, then really go for it,” she affirms. “Push. Work your ass off. Show people who you are. Because it is so worth it when you love what you do!”
