Sexpo Australia Canceled as Parent Company Pursued by Creditors

SYDNEY — Sexpo Australia has reportedly been canceled following the collapse of its parent company, Australian Exhibition Group Pty. Ltd. (AEG).

In August, a creditor filed an application with the Supreme Court of Victoria for a Winding Up Order against AEG, which is a legal request to shut down a company due to unpaid debts.

The matter was heard on Sept. 23, and that same day, AEG informed interested parties that the upcoming Australian events, including the Oct. 4-6 Adelaide expo, were postponed indefinitely.

“The company has begun the process of entering into administration as the deadlock and legal fees make it impossible for the business to continue operating,” the company told exhibitors.

Sexpo founder David Ross, who sold the company to AEG in 2019, expressed his dismay at the situation.

“After the 2019 sale of Sexpo Australia to Australian Exhibition Group Pty. Ltd., I no longer have any interest in the local event, but still, it’s a crying shame to see what’s happened to my baby,” he said, adding, “I have received numerous phone calls from disgruntled exhibitors, telling me that Sexpo Australia (AEG) was still sending out invoices and reminders, and accepting payments until at least midday on Sept. 23, just hours before the postponement notice was sent.”

Maxine Fensom, owner of the affiliated Sexpo U.S.A., clarified that her organization is not connected to AEG but noted similar complaints from Australian exhibitors.

“The action against Australian Exhibition Group Pty. Ltd. (AEG) has no effect on Sexpo U.S.A. operations as AEG has no interest in the U.S.A. Sexpo trademark,” she said. “Exhibitors and the public are equally disgruntled due to the last-minute nature of the cancellation, and the lack of communication from Sexpo Australia’s management, leaving them out of pocket for all the expenses associated with traveling to and exhibiting at a major event.

“The brand may now be too damaged to consider buying the trademark, but the name of the event is less important than giving the public what they want from an adult exhibition, so we are also considering launching under another name.”

Ross agreed that he hopes to move forward with a similar event.

“I have a very good reputation amongst Sexpo exhibitors and so the fact that the local brand is now tarnished, it may be that the Australian trademark is worth nothing, except, possibly, to Maxine and myself,” he said. “In fact, I have been contacted by several affected exhibitors asking if I have any intentions to launch a new event, stating they would be happy to be involved.

“We are currently seeking expressions of interest from potential investors to launch a new event.”

South Dakota Lawmaker Vows to Revisit Age Verification Bill in 2025

PIERRE, S.D. — A South Dakota state representative has vowed to reintroduce legislation in the 2025 session that would impose age verification restrictions on adult websites.

Representative Bethany Soye, R-Sioux Falls, is leading a group of lawmakers pushing for a vote on a revised bill, after House Bill 1257 was killed by the state Senate in March over concerns about its constitutionality, as well as technical and enforcement issues.

“The pornography industry is not welcome here in South Dakota to prey on our children,” said Soye. “Their innocence is not for sale. We must protect our kids, and I urge my colleagues to stand with me.”

The revised legislation, which applies to sites that “create, host, or make available material harmful to minors,” would require sites to impose strict age verification processes, including the use of government identification.

It would also impose criminal penalties for noncompliance, with sites receiving one written warning before prosecution.

The revised bill still faces opposition in the state Senate, with Sen. Helene Duhamel, R-Rapid City, expressing concerns over the enforceability of the legislation as well as its potential financial burden on the state.

“We do not want South Dakota taxpayer dollars awarded to pornographers by a judge because we passed a bad law,” said Duhamel, who chairs the subcommittee on protecting minors from harmful content. “And we do not want to give any of these sketchy companies access to state databases for their age verification.”

However, South Dakota’s Republican attorney general, Marty Jackley, has voiced his backing for age verification restrictions.

“I support age verification for illicit websites,” he stated.

“Illicit” means “against the law,” suggesting that Jackley may be unaware that adult websites are legal in South Dakota and every other U.S. state, as protected speech under the First Amendment.

Jackley received a law degree from the University of South Dakota School of Law.

In justifying her position, Soye, who serves on the legislature’s Summer Study Committee on Artificial Intelligence and Internet Regulation for Minors, cited spurious psychological claims that pornography is damaging.

“It’s time for us to stop playing political games and pass this bill to protect our children from the harms of pornography,” she said. “We know that pornography damages young minds, leading to lifelong emotional and psychological harm.”

Tech Companies Propose ‘Safety Codes’ to Comply With Australia’s Online Censor

CANBERRA, Australia — A group of Australian trade organizations released on Monday a draft of a proposed online “safety codes” system meant to protect children from exposure to online pornography and other material categorized as “harmful content.”

The proposed safety codes, which could become enforceable if ratified by the country’s controversial eSafety Commissioner Julie Inman Grant, were developed by the Digital Industry Group Inc. (DIGI), the Australian Mobile Telecommunications Alliance, the Consumer Electronics Suppliers Association and the Interactive Games and Entertainment Association.

DIGI, which is actively promoting the proposal and is credited by some reports as its main booster, describes itself as “a not for profit industry association advocating for the digital industry in Australia” and “the industry association for companies that invest in online safety, privacy, cyber security and a thriving Australian digital economy.”

Its members are all large multinational corporations, including Apple, Discord, eBay, Google, Meta, Microsoft, Pinterest, Snapchat parent company Snap, Spotify, TikTok, Twitch, X and Yahoo.

XBIZ confirmed that Free Speech Coalition (FSC) was consulted in drafting this system, which directly targets adult content and would affect access to adult sites in Australia. When reached, FSC was still reviewing the proposal to assess how much of its input had been included.

According to News.com.au, the codes “could become enforceable by the eSafety Commissioner if accepted for registration under the Online Safety Act 2021.”

Big Tech Following Inman Grant’s Directives

As XBIZ reported, the Online Safety Act essentially established the eSafety Commissioner as Australia’s de facto online censor. Currently, the post is held by Inman Grant, an unelected American-Australian former tech executive who has acknowledged having had conversations with U.S.-based, religiously-inspired lobby NCOSE — formerly Morality in Media — and even appeared on an NCOSE podcast at the Coalition to End Sexual Exploitation summit in July 2021, shortly after the Australian Parliament passed the OSA.

According to the Australian Associated Press (AAP), the codes follow a directive by Inman Grant to companies to protect children from Class 1C and Class 2 material, which include “pornography, simulated gambling in computer games and ‘high-impact material’ depicting nudity, violence, drug use, crime, suicide, racism or family breakdowns that would otherwise receive an R18+, X18+ or RC classification.”

The directive mandates “tools to let users block pornographic images sent to them,” as well as “ways to report breaches, and terms and conditions to prohibit sexual extortion, grooming and non-consensual intimate image sharing,” AAP reported.

DIGI’s Director of Regulatory Affairs and Research Policy Jennifer Duxbury described the draft online safety codes as “a critical step forward in keeping children safe from pornography and inappropriate content,” News.com.au reported.

“The draft safety codes we’ve released today are a joint effort between companies committed to online safety and the government to strengthen safeguards for minors when it comes to online pornography and age-inappropriate content,” Duxbury said. “The key principles of these codes are to protect and support children, provide all end users, including parents, with more control over what their children see, read and hear and to protect privacy and online safety.

“Importantly, the draft online safety codes will also include measures such as how digital platforms will approach age assurance,” she added. “Once finalized, these draft safety codes will make an invaluable contribution to protecting children from online pornography and other harmful content.”

Duxbury also said DIGI was encouraging “all stakeholders, including consumer organizations, civil society groups, academics, industry, parents and community members, to have their say on the draft codes and provide feedback.”

Public consultation about the proposed ratings system is open until Nov. 22, and can be accessed through OnlineSafety.org.au.
