LOS ANGELES — PASS has launched a new contact tracing program for Mycoplasma genitalium (Mgen) cases in the adult industry.

PASS has launched a new contact tracing program to help mitigate the spread of Mycoplasma genitalium (Mgen) in the adult industry.

With typical testing and treatment of reduced efficacy for Mgen, the tool will enable PASS to target people at the highest risk, and thus minimize the potential of additional transmission. All talent who participate in PASS are required to be tested for Mgen by Oct. 1.

Performers who have received a positive Mgen result can anonymously use this form to identify recent sexual partners. PASS will then reach out to notify them that they have been potentially exposed, and help them get tested, and if needed, treated.

PASS Executive Director Ian O’Brien says the contact tracing program is critical in protecting performers.

“Mgen presents a complex challenge for the adult community, which means we need to be aggressive in confronting its spread. PASS has long used contact tracing to identify, notify, and monitor individuals who may have been exposed to an infectious disease, but we’ve never done something on this scale. With the community’s help, we can quantify and identify risk and begin to more effectively treat Mgen.”

The contact tracing program builds on recent guidance published by PASS.

AUSTIN, Texas — A three-judge panel of the 5th Circuit Court of Appeals issued on Tuesday an “administrative stay” on the injunction obtained last month by Free Speech Coalition (FSC) and other plaintiffs, creating a confusing situation around the enforcement of Texas’ controversial “age verification” law that unconstitutionally mandates adult websites to post anti-porn propaganda.

In a two sentence ruling which offers no details or explanations, the panel effectively removed the preliminary injunction, “meaning that the law is immediately in effect,” TechDirt’s Mike Masnick reported.

As XBIZ reported, on Aug. 31 a federal court in Texas granted the preliminary injunction to (FSC) and its co-plaintiffs, thereby blocking the Texas attorney general from enforcing the state’s controversial anti-porn age verification law while the case is litigated.

The Republican-authored HB 1181 was passed by the Texas legislature with bipartisan support in May and was scheduled to go into effect Sept. 1.

FSC Director of Public Affairs Mike Stabile confirmed to XBIZ that the 5th Circuit “has temporarily stayed our preliminary injunction in Texas, in favor of an expedited hearing by a different panel of judges, who will take a closer look at the law in the next few weeks.

“While we remain confident the injunction will hold,” Stabile added, “there remains potential risk for adult businesses in the meantime. However, we have reason to believe that the Attorney General’s office will refrain from enforcing the law until that hearing. If, however, anyone is receives contact from the state of Texas, or anyone else attempting to enforce the law at this time, we ask that they immediately contact FSC.”

A Predictably Partisan Decision by the 5th Circuit Judges

Industry attorney Lawrence Walters, from the Walters Law Group, told XBIZ that the district court’s order granting the injunction against the age verification obligations and compelled “health warnings” for adult websites was “thorough and well-reasoned.”

“It is very unusual for a federal appeals court to effectively reverse such an injunction without any legal analysis,” Walters explained. “This odd turn of events has created some legal chaos in the short term, which will hopefully be cleared up soon by expedited court proceedings.”

According to Masnick’s analysis, the cryptic Fifth Circuit decision was predictable partisan and inconsistent with both First Amendment jurisprudence and some of the court’s own recent decisions.

“Just last week we wrote about the decision in the 5th Circuit saying that the government cannot coerce websites regarding how they moderate content,” Masnick wrote. “We noted that this seemed to be in near total conflict with last year’s 5th Circuit ruling saying that of course governments can tell websites how to moderate (the only point on which they are consistent is that ‘it’s okay when Republicans do it, and not okay when Democrats do it’).”

Tuesday’s decision, Masnick added, the two-line decision apparently reinstating HB 1181 mandate to force adult websites to post supposed “Texas Health and Human Services” warnings, which originate in religiously inspired anti-porn propaganda rather than the Texas Health and Human Services Department.

The 5th Circuit decision ignores the lower court’s opinion that the warning violates constitutional protections against “compelled speech,” and, as had happened before in other cases where the court appeared to rubberstamp decisions by Republican politicians, provides no explanation as to why.

“Once again, the ruling gives no details at all,” Masnick added. “It’s two sentences this time (up from one the last time), and just effectively removes the preliminary injunction, meaning that the law is immediately in effect. The only difference from last year’s similar nonsense is that the court says the appeal is ‘expedited’ to the next available oral argument panel.

“Either way, the law is now in effect and we have no idea what that means because the 5th Circuit has explained nothing,” Masnick concluded.

AUSTIN, Texas — The leader of the American Principles Project (APP), a well-funded, anti-porn conservative lobby, said Wednesday that the ultimate aim of the age verification laws currently being passed in various states is to create a private right of action, so that parents could directly sue online companies if their children are able to access adult content.

The APP’s Terry Schilling told right-wing news site the Daily Caller that he considers the entire adult industry to be “very dishonest.”

“So the real issue with leaving it all up to the state agencies is that it’s technically in their discretion,” Schilling told the Tucker Carlson-founded outlet. “The way to strengthen these laws is to not take away power from the agencies to enforce these laws, but to give additional power to parents to sue these companies, if and when they find porn from their production studios or websites on their children’s devices, or when they find that someone in their family has looked at this stuff.”

Schilling’s strategy mirrors the so-called “bounty hunter” strategies used against abortion seekers and providers in some states, where civil liability has been created to bypass civil rights and free speech protections.

As XBIZ reported, Schilling has been unusually candid during this election cycle about the conservative effort to outlaw all content his group considers “pornography.”

Last year, Schilling bragged that his group was behind the current Republican-led book-banning movement, and that his goal was to purge what he calls “pornography” from libraries.

In July, Schilling took credit for the current slew of age verification laws passed in recent months by several states, and admitted they were experiments so that the next Republican U.S. attorney general can prosecute anyone uploading adult content that could be accessed by a minor.

“What we wanted to do was build momentum at the state level, show that it can be done, use the laboratories of democracy, and then build up momentum to get the next attorney general of the United States to actually enforce these laws and require these companies to verify that these are actually adults, not children, that are viewing this obscene material,” Schilling told Fox News.

SAN JOSE, Calif. — A federal judge on Monday issued an injunction blocking the California Attorney General from enforcing the controversial California Age-Appropriate Design Code Act (CAADCA), which was passed last year after lobbying from a British baroness.

U.S. District Judge Beth Freeman stated that “the law’s commercial speech restrictions likely violate the U.S. Constitution’s First Amendment,” Reuters reported.

Freeman added that although she was “keenly aware of the myriad harms that may befall children on the internet,” CAADCA was likely unconstitutional in the form passed unanimously by the state legislature and emdorsed by Governor Gavin Newsom.

Big Tech trade group NetChoice sued last December to block CAADCA, claiming the law “would pressure private companies into becoming ‘roving censors’ of content that California deems harmful, or else face ‘draconian penalties’ as high as $7,500 per child per violation,” Reuters reported.

British Interference in U.S. Free Speech Issues

As XBIZ has been reporting, California’s controversial CAADCA, was drafted and lobbied for by British Baroness and filmmaker Beeban Kidron.

Kidron’s lobbying is another instance of U.S. anti-porn politicians importing British “experts” to share their opinions on American free speech issues. Though termed a “constitutional monarchy,” the U.K. has no written constitution and no equivalents to the U.S. Bill of Rights, First Amendment or codified Section 230 protections.

The California Age-Appropriate Design Code Act was patterned after the U.K.’s “Children’s Code,” a set of regulatory standards devised by the Baroness Kidron. Kidron also funds the 5Rights Foundation, a nonprofit that backed the bill. One of the 5Rights Foundation’s goals is to expand the scope of the federal Children’s Online Privacy Protection Act and change the definition of “child,” for online purposes, from anyone under 13 to anyone under 18.

Baroness Kidron is a 63-year-old former photographer, film producer and director, philanthropist and self-appointed “advocate for children’s rights in the digital world.”

Her U.K. feature films include “Vroom,” “Oranges Are Not the Only Fruit” and “Antonia and Jane.” In 1992 she moved to the U.S., where she worked with Miramax Pictures’ Harvey Weinstein. She directed “Used People,” the sex work documentary “Hookers, Hustlers, Pimps and Their Johns,” “Shades of Fear,” “To Wong Foo, Thanks for Everything! Julie Newmar” and romantic comedy sequel “Bridget Jones: The Edge of Reason,” starring Renée Zellweger, Colin Firth and Hugh Grant.
