Judge Pauses FSC Lawsuit Over Florida AV Law

TALLAHASSEE, Fla. — A U.S. district court judge has paused Free Speech Coalition’s lawsuit over Florida’s age verification law, pending the Supreme Court’s ruling in the FSC-led challenge to Texas’ age verification law, HB 1181.

According to court documents, Chief United States District Judge Mark E. Walker, of the United States District Court for the Northern District of Florida, granted Florida Attorney General Ashley Moody’s motion for a stay of proceedings until the U.S. Supreme Court issues a ruling in Free Speech Coalition v. Paxton. Oral arguments in that case took place Jan. 15.

In his opinion, Walker noted, “It was apparent from the arguments that the Supreme Court’s ruling in this case is substantially likely to inform this Court’s analysis of Plaintiffs’ First Amendment claim, the level of scrutiny that should apply, and how that may impact the merits of Plaintiffs’ claim.”

On Dec. 24, Moody filed the motion asking the court to stay the FSC lawsuit challenging HB 3, the state’s age verification law, which took effect Jan. 1. At the time, adult industry attorney Corey D. Silverstein told XBIZ that granting the motion would penalize adult sites operating in Florida without due process.

“Florida lawmakers are ignoring the constitution, just as in other states that have passed these laws, as well as ignoring existing case precedent that these laws are unconstitutional,” he said.

As XBIZ reported earlier this month, the ramifications of HB 3 are already being felt. Aylo geo-blocked Pornhub in Florida starting on Jan. 1, as it has done in numerous other states with similar AV laws.

“This Court recognizes that Plaintiffs’ speech is chilled every day the challenged law is in effect, but, given the substantial guidance the Supreme Court is likely to provide in its ruling in Paxton and the impact this guidance will have on this Court’s analysis of Plaintiffs’ primary constitutional claims … this Court concludes that a limited stay of these proceedings is both appropriate and necessary in this case,” Walker wrote.

The suit is stayed until the Supreme Court issues its opinion in FSC v. Paxton, or until July 3, whichever happens sooner.

Indiana AG Sends Cease and Desist Letters to Adult Sites Over AV

INDIANAPOLIS — Indiana Attorney General Todd Rokita sent several cease and desist letters to adult websites Wednesday, accusing them of failing to comply with the state’s age verification law.

The letters were sent on the same day that the U.S. Supreme Court heard oral arguments on a legal challenge to Texas’ age verification law. According to an industry source close to the legal proceedings, Rokita sent at least a dozen letters.

XBIZ has obtained a copy of the letter from the principal of one adult site that received it, who asked not to be identified on advice of counsel.

“[O]n December 31, 2024, an investigator employed by the Office of the Indiana Attorney General accessed [redacted] pornographic website in Indiana and discovered that the website lacked any form of age verification to protect minors from accessing the harmful sexual material published on the website,” the letter states.

“The Office of the Indiana Attorney General demands that [redacted] acknowledge this Cease and Desist Notice within 14 days of receipt to confirm that reasonable age verification has been implemented in accordance with Indiana law.”

The letter also outlines some of the potential penalties for noncompliance, including civil penalties of up to $250,000 plus the cost of the investigation and enforcement action.

Adult industry attorney and First Amendment expert Corey D. Silverstein, whose legal firm represents several clients who received the letter, warned that compliance with the letter’s demand was no guarantee of avoiding future litigation.

“This is a serious development, and recipients of the letter should seek immediate legal counsel, because even if the recipient starts complying with the law today, they could still be on the hook for the previous violations,” he said. “It is very brazen of the Indiana attorney general to take this approach, given that Indiana’s age verification law is currently being challenged by the Free Speech Coalition and already has gone up to the circuit court of appeals.”

Silverstein opined that Rokita may have deliberately picked yesterday to send the letters — while the U.S. Supreme Court was in session hearing arguments on the Texas case — to “intimidate website operators and cause angst.”

“I find it quite unprofessional and almost childlike behavior on the attorney general’s part,” he said.

Ofcom Releases Age Assurance Guidelines

LONDON — U.K. communications regulator Ofcom released on Thursday its finalized official guidance on what constitutes “highly effective” age assurance, which adult sites are required to implement under the U.K.’s Online Safety Act (OSA).

Ofcom’s plans for implementing the OSA’s provisions have been rolled out in phases. This latest announcement notes that:

  • Services that publish their own pornographic content — such as studios and pay sites — must introduce age checks immediately.
  • Services that allow user-generated pornographic content — such as social media, tube sites, cam sites and fan platforms — must introduce age checks no later than July.
  • An enforcement program will be monitoring industry compliance.

The statement also clarifies that for the purposes of OSA compliance, “highly effective” age assurance means age-checking methods that are “technically accurate, robust, reliable and fair.”

The guidance then provides what it terms “a non-exhaustive list” of methods it considers “capable of being highly effective.” That list includes “open banking, photo ID matching, facial age estimation, mobile network operator age checks, credit card checks, digital identity services and email-based age estimation.”

It further notes, “While we have decided not to introduce numerical thresholds for highly effective age assurance at this stage (e.g. 99% accuracy), we acknowledge that numerical thresholds may complement our four criteria in the future, pending further developments in testing methodologies, industry standards, and independent research.”

The guidance specifies that “methods including self-declaration of age and online payments which don’t require a person to be 18 are not highly effective.”

“Our approach is designed to be flexible, tech-neutral and future-proof,” reads the statement by Ofcom Chief Executive Melanie Dawes. “While providing strong protections to children, our approach also takes care to ensure that privacy rights are protected and that adults can still access legal pornography.”

While the statement notes “expectations” that sites and apps will respect privacy rights, it does not provide guidelines for privacy protection.

Tim Henning, Executive Director of the Association of Sites Advocating Child Protection (ASACP), said in a statement, “ASACP believes that all apps, platforms and sites that allow, enable or feature adult-oriented content should comply with the U.K. mandate, regardless of their location or primary market. Doing so not only helps to protect children, but it’s good business too!”

Ofcom announced that it is opening an age assurance enforcement program, focusing first on services that display or publish their own pornographic content.

“We will contact a range of adult services — large and small — to advise them of their new obligations,” the statement explains. “We will not hesitate to take action and launch investigations against services that do not engage or ultimately comply.

“For too long, many online services which allow porn and other harmful material have ignored the fact that children are accessing their services,” the statement continues. “Either they don’t ask or, when they do, the checks are minimal and easy to avoid. That means companies have effectively been treating all users as if they’re adults, leaving children potentially exposed to porn and other types of harmful content. Today, this starts to change.”
