CamSoda Hosts Chloe Surreal Livestream Tonight

LOS ANGELES — Chloe Surreal will host her first-ever livestream tonight on CamSoda at 5 p.m. (PDT).

Amazon Reportedly to Settle FyreTV Trademark Lawsuit

ATLANTA, Ga. — Amazon and FyreTV owner Wreal are reportedly finalizing a confidential settlement regarding the lawsuit originally brought by the adult streaming service in 2014 over trademark infringement.

The settlement was first reported by Bloomberg Law earlier this month.

As XBIZ reported, in June 2022 the 11th U.S. Circuit Court of Appeals ruled the case against Amazon over its name-alike Fire TV product, could move forward.

The appellate court’s opinion overturned a Florida federal judge’s decision which had granted summary judgment in Amazon’s favor.

Wreal’s original complaint alleged Amazon’s Fire TV could cause consumers to mistake it for its adult FyreTV service, which were trademarked in 2007.

In May 2019, a previous district judge overseeing the case had recommended “granting Amazon summary judgment after finding little chance that consumers would confuse a normal streaming device with an app dedicated to hardcore pornography,” Law360 reported.

The 11th Circuit considered the situation instead as a “reverse-confusion” case.

“In reverse-confusion cases, the plaintiff is usually a commercially smaller, but more senior, user of the mark at issue,” the appellate judges explained. “The defendant tends to be a commercially larger, but more junior, user of the mark.”

Although the lower court “had found that consumers were unlikely to confuse the two marks,” the appellate judges ruled that the district judge “should have analyzed whether Amazon’s Fire TV mark could cause a consumer to associate FyreTV with Amazon,” Law360 reported.

The panel also found that “although Amazon’s product does not broadcast hardcore pornography, it does have apps for Showtime and HBO Go, both of which broadcast softcore pornography as part of their after-hours programming,” Law360 explained, adding that “hardcore pornographic DVDs are also available for purchase on Amazon.com.”

The panel held that it would thus “not be unreasonable” for a consumer to think Amazon was behind FyreTV.

At the time of Amazon’s Fire TV’s release, a Fortune report on the current settlement negotiations explained, “customers who went to firetv.com likely received a shock” because FyreTV “had acquired that domain three years earlier, apparently expecting people to misspell its name. Subscribers were able to stream explicit XXX content directly to their TVs via Roku and other third party set-top boxes at the time.”

Since 2014, Amazon has shipped more than 200 million Fire TV devices, Fortune reports.

FSC Warns of Risks to Adult Sites If Texas Age Verification Law Takes Effect Sept. 1

LOS ANGELES — Free Speech Coalition (FSC) issued a statement urging industry stakeholders to prepare for the new Texas age-verification and labeling law taking effect Sept. 1.

While multiple age-verification laws have taken effect this year, Texas’ will join Louisiana in allowing direct government enforcement. According to the law, the Attorney General may fine a site with adult content $10,000 per day, and up to $250,000 if it fails to adequately verify the age of visitors and a minor is able to access it.

Additionally, the Texas law requires all adult sites to affix warning messages to any page with adult content stating the alleged harms of viewing adult material.

Free Speech Coalition and a collection of leading adult platforms have filed a legal challenge to the Texas law, including a motion for preliminary injunction. While we are hopeful the challenge will succeed, and that a decision will be made prior to the start of enforcement, all members should be aware of the law and the risks of non-compliance.

“This is a blatantly unconstitutional law, but the stakes are high for individual adult businesses with websites accessible in the state of Texas,” says Alison Boden, Executive Director of Free Speech Coalition. “We urge every platform and creator to review their potential exposure to legal liability with their legal counsel.”

Free Speech Coalition has created landing pages for platforms that geo-block access to their sites from within the state of Texas, as it has in other states that have instituted age verification. The page explains why the site is blocked, and provides an avenue for residents to contact their representatives. However, geo-blocking a state does not necessarily provide safe harbor from the law.

Coyote Ventures’ Jessica Karr Speaks About Sextech to TechCrunch

SAN FRANCISCO — TechCrunch on Monday published an interview with investor Jessica Karr, co-founder of Coyote Ventures, a VC firm focusing on women’s health and wellness.

Karr, who has invested in women’s health ventures like Gabbi, The Beans and Betterleave, offered her thoughts on the sextech sector.

“A lot of folks are uncomfortable with acknowledging sex at all,” Karr told TechCrunch. “I’ve discussed my sextech investments with females at other funds who laughed when they imagined trying to get the deal through their all-male investment committee. A lot of the sextech companies I’ve seen are addressing the gap that most sex-related products were designed by men, with a ‘male gaze’ lens rather than an actual understanding of female pleasure.”

Karr sees sextech currently as “an inclusive space” and praised “many new products that are innovative for gender inclusivity as well as sexual wellness for men.”

She also addressed the “vice clauses” in limited partner agreements (LPAs), which stigmatize investment in sex-related businesses. These clauses vary and may become more restrictive with more institutional investors, she explained.

“Emerging funds have the flexibility to negotiate the scope of the vice clause,” she noted. “While some pornography-related vice clauses tend to be upheld, including in my LPA, my institutional investors acknowledge that our sextech investments are not pornography and the investments are acceptable to them. I do recognize there are some exciting companies innovating in the ethical and inclusive pornography space, and it’s unfortunate that these are more restricted due to the vice clause.”

According to TechCrunch’s Dominic-Madori Davis, funding for the sextech industry has remained “relatively steady” over the years.

Davis reports that sextech startups raised $352 million in 2020 and $422 million in 2021. While the number fell to $275.8 million in 2022, the decline was nevertheless “in line with the general slowdown in venture capital investing.”

This year, according to the article, sextech startups have raised $111.9 million so far, and are on track to match or surpass the 2022 figure.

Ultimately, Karr sees a fruitful future for sextech investments and for social change regarding sexuality, especially as Gen Z consumers play a more decisive role.

“I’m excited to continuously understand more about our bodies,” she said. “There’s a big opportunity to connect more with the biohacking and longevity communities, recognizing how much of a correlation exists between sexual health and overall health.”
