NCOSE Goes All-In on Banning Adult Content Online With 2023 Target List

WASHINGTON — Religiously inspired anti-porn lobby NCOSE released this week its latest annual “Dirty Dozen” list of companies it is currently targeting, focusing exclusively on online platforms, websites and companies.

Unlike previous lists — which variously included hotel chains, government and military departments and even the entire state of Nevada — the 2023 list of NCOSE targets signals a commitment to the group’s single-minded campaign to eradicate or severely limit access to adult content online.

The 12 companies the group — formerly known as Morality in Media — is spotlighting as “dirty” in 2023 are: Apple’s App Store, Discord, eBay, Instagram, Kik, Microsoft’s GitHub, OnlyFans, Reddit, Roblox, Spotify and Twitter.

Identifying Instagram as “dirty” confirms the group commitment to ensuring that the company continues its policy of discrimination against sex workers and sexual content. As XBIZ reported, NCOSE has boasted of holding policy meetings with Instagram leadership, which the Meta company has not denied.

The inclusion of Reddit and Twitter reinforces the group’s current core mission of forcing those two open platforms to ban all adult content. NCOSE is also attempting to obtain the same result by lobbying Apple’s App Store — also included this year among the “dirty” companies — to pressure Reddit and Twitter to eliminate all adult content and sex worker accounts.

“Those on our 2023 Dirty Dozen List were included for facilitating a diverse set of sexual exploitation issues,” claimed NCOSE’s Vice President and Director of Corporate Advocacy Lina Nealon while unveiling the group’s list on Instagram.

Nealon — who admittedly spends time on Snapchat impersonating a 14-year-old girl for research purposes — also stated her notion that “sexual abuse and exploitation are on the rise and are facilitated by digital platforms” and called for tech platforms “to stop their products from threatening the safety of children and enabling sexual abuse to happen to people of all ages.”

Religious News Sites Echo NCOSE’s Target List

Religious news sites immediately echoed NCOSE’s annual hit list. The Baptist Press asserted that the anti-porn group provided “documented examples directly captured from the tech sites and corroborating information supporting the accusations of sexual exploitation, with avenues for public advocacy for change.”

Last month, NCOSE launched a new campaign to eradicate all adult content on Reddit, another of its “dirty” companies. In an open letter, the group calls for the platform to take action against “hardcore pornography and sexually explicit content.”

Founded in 1961 by clergy, NCOSE rebranded in 2015, adopting its current name, the National Center on Sexual Exploitation — but has maintained its media censorship focus, even recently labeling mainstream publications like Sports Illustrated and Cosmopolitan “hardcore pornography.”

NCOSE considers all sexually explicit content, regardless of consent, to be exploitative, likens it to trafficking, and has denied the very possibility of consensual sex work.

FSC Files Legal Challenge to Utah's Anti-Porn Law

LOS ANGELES — Free Speech Coalition filed suit Wednesday in the United States District Court for the District of Utah to overturn the state’s new anti-porn law, SB 287.

The complaint asks for declaratory and injunctive relief against the law on account of violations of the First and 14th Amendments. 

Joining Free Speech Coalition in filing the challenge are Andrea Barrica, founder of the sex education site O.school; journalist, educator and content creator Charyn “Ryn” Pfeuffer; Utah-based erotica writer D.S. Dawson; “John Doe,” a pseudonymous Utah-based attorney; and fan platform JustFor.Fans.

The parties are represented by Jeffrey Sandman of Webb Daniel Friedlander LLP, D. Gill Sperlein of the Law Office of D. Gill Sperlein and Jerome Mooney of Weston, Garrou & Mooney Law Firm, on a pro bono basis.

“The Utah law restricts adults’ access to legal speech and violates decades of Supreme Court precedent,” said Alison Boden, executive director of Free Speech Coalition. “We are fighting not only for the rights of our members and the larger adult entertainment community, but for the right of all Americans to access constitutionally protected expression in the privacy of their own home.”

Utah’s SB 287 requires that visitors to adult sites prove that they are over 18 years of age, such as by providing digitized government identification to a service that interacts with a state database. However, the state of Utah does not currently have the capability to verify digital IDs online.

The complaint, an FSC rep explained, “details a litany of constitutional issues, including prohibitions on prior restraint of speech, compelled speech, and violations of Section 230 of the Communications Decency Act. In 1997, the Supreme Court ruled that age-verification requirements like the one instituted in Utah are unconstitutional so long as other less intrusive methods — such as device-level internet filters — are available.”

“We wrote to Utah during the legislative process raising these issues and asking for a dialogue around workable solutions, but were ignored,” Boden added. “Adult websites don’t want children accessing their content any more than the state of Utah does. But the solutions put forward in SB 287 put an unreasonable burden on free expression that we believe are meant to have a chilling effect for all Utahns.”

SAN FRANCISCO — The Ninth U.S. Circuit Court of Appeals today dismissed a lawsuit sponsored by anti-porn activists against Twitter over user-uploaded content, upholding Section 230.

As XBIZ reported, religiously inspired anti-porn lobby NCOSE (National Center on Sexual Exploitation, formerly known as Morality in Media) helped file a lawsuit in January 2021 against the platform over posts that include nude photos of minors. The plaintiffs claimed Twitter was liable due to the Section 230 loophole opened by the passage of FOSTA-SESTA legislation in 2018.

U.S. Magistrate Judge Joseph Spero had ruled that Section 230 “shielded Twitter from the families’ claims of participating in child pornography and sex trafficking but allowed them to sue the company for allegedly profiting from the traffickers’ illegal conduct,” the San Francisco Chronicle reported today. “The appeals court, however, said such claims were also barred by a Ninth Circuit ruling last fall in a suit against the online network Reddit.”

The lawsuits were filed in San Francisco on behalf of two men, only identified as John Doe, who were minors at the time of the posts.

“One, who lives in Florida, said he was duped into posting nude photos in 2017 by someone posing as a 16-year-old girl at his school, then blackmailed into providing additional sexually explicit photos and videos by traffickers who threatened to tell his parents and others if he refused,” the Chronicle reported. “After his classmates began viewing the videos in 2020, the suit said, the youth faced harassment and bullying and became suicidal, while the other John Doe dropped out of school.”

NCOSE’s lawyers built their argument on FOSTA-SESTA’s claim that Section 230, the so-called “First Amendment of the internet,” was “never intended to provide legal protection to websites that unlawfully promote and facilitate prostitution and websites that facilitate traffickers in advertising the sale of unlawful sex acts with sex trafficking victims” and “websites that promote and facilitate prostitution have been reckless in allowing the sale of sex trafficking victims and have done nothing to prevent the trafficking of children and victims of force, fraud, and coercion.”

Their lawsuit made several mentions of a 2018 Amnesty International report called “Toxic Twitter, A Toxic Place for Women” and took aim at Twitter’s moderation policy, claiming that “as long as content on Twitter’s platform remains live, Twitter monetizes that content regardless of whether it is contrary to Twitter’s own policies or promotes illegal conduct.”

Twitter, the lawsuit claims “thus profits from content on its platform that depicts rape, sex trafficking, child sexual abuse and other illegal activity.”

The ACLU and Free Speech Coalition successfully argued in a filing that encouraging the lawsuits promoted by NCOSE and other anti-Section 230 groups would force Twitter, Reddit and other open platforms to either “remove protected, societally beneficial content to avoid the threat of liability — thereby depleting the full scope of speech and information available to the public — or they would opt to remain willfully ignorant of content posted on their services to avoid having any possible awareness (and therefore arguably constructive knowledge) of illegal content appearing there.”
