France’s Porn Block: Details of MindGeek’s Constitutional Challenge Explained

PARIS — Legal analysts published this week a detailed explanation of MindGeek’s ongoing constitutional challenge against a French media regulatory agency’s attempt to completely block adult sites in the country over age-verification compliance.

As XBIZ reported, the current case moving through French court originated with a War on Porn-driven attempt by French non-profit groups claiming to be acting on behalf of “the children.”

Julia Apostle and Meg Hennessey of San Francisco-based international law firm Orrick, Herrington & Sutcliffe LLP published their analysis on legal resource site JD Supra.

Apostle and Hennessey noted that during a Sept. 6 hearing, “lawyers acting for MG Freesites Ltd. (operators of the Pornhub website), raised a constitutional challenge against a recent law that permits France’s online content regulator (ARCOM) to seek a blocking order targeting websites that fail to prevent minors from accessing online pornography.”

Two days later, the Paris Judicial Tribunal “issued a decision requiring all parties to attend a mediation-information session in the hopes of finding a solution.”

The decision about “whether to refer the constitutional challenge to the higher court” is expected on Oct. 4, when the Tribunal must decide whether MindGeek’s challenge “meets the criteria to be sent to the French Cour de Cassation for full arguments.”

ARCOM Failed to Provide Guidance on Age Verification

According to Apostle and Hennessey, the constitutional challenge raised by MindGeek depends on two arguments: 1) “Given the absence of effective technical solutions it is not possible for the company to comply with the law and thus the law is unconstitutional,” and 2) “The law violates freedom of expression due to its lack of proportionality, with a particular emphasis on its ultimate ineffectiveness (due to the widespread use of VPNs) and an absence of necessity in light of a recently adopted law that will require terminals devices to default to parental controls.”

The legal analysts point out that media regulator ARCOM “has not released any guidance regarding age verification tools that it would consider sufficient to comply with the French Criminal Code provision.”

Moreover, MindGeek lawyers argue that ARCOM “also failed to respond to repeated requests to engage in discussions regarding possible solutions,” confusingly answering one of the queries by claiming that “there may be as many viable solutions as porn sites available in France, a figure estimated to be approximately 4 million, according to MG Freesites.”

To compound the confusion, French data protection regulator CNIL recently stated in a report on age verification that “there are currently no available solutions that are both effective and privacy preserving.”

ARCOM’s lawyers maintain that the constitutional challenge presented by MindGeek’s lawyer does not meet the criteria to be sent to the French Cour de Cassation for full arguments.

India’s Supreme Court Rebukes Attempt to Codify Link Between Porn, Sex Crimes

India's Supreme Court Rebukes Attempt to Codify Link Between Porn, Sex Crimes

NEW DELHI — The Supreme Court of India has rejected a petition seeking to codify an alleged link between viewing internet pornography and committing crimes such as rape and child sexual abuse.

“Seeking a judicial declaration from the Supreme Court that porn on the Internet has led to child sex crimes would be equal to giving a go-ahead to online surveillance,” cautioned the justices in their opinion after reviewing the petition, Indian newspaper The Hindu reported.

The top Indian tribunal stated that “child sex abuse is a crime by itself” and noted that although police can investigate specific cases to determine “whether or not viewing of pornography had triggered the crime,” such findings would apply only to each individual case.

“So your final goal is that such material should not uploaded … What you are advocating may be surveillance and collection of data,” the court told Nalin Kohli, the petitioner-in-person and a prominent figure in the BJP, India’s right-wing ruling party.

The court expressed concern about where the type of Internet surveillance being proposed might lead.

“This is a tiger if it gets loose, problem is at what point we control it… The issue of the link between viewing pornography and crime is individual case specific,” Chief Justice Lalit opined.

Influence of U.S. Jurisprudence on India’s Supreme Court

Justice S. Ravindra Bhat cited a 1990s U.S. Supreme Court case dealing “with a question of banning the Internet to a certain class in order not to give them access to porn,” The Hindu reported.

Bhat quoted former U.S. Supreme Court Justice Anthony Kennedy as saying, “We cannot set the house on fire to roast the pig,” in turn a reference to a much-cited 1957 case, Butler v. Michigan.

According to free-speech scholar Clay Calvert, Justice Felix Frankfurter’s opinion in the Butler decision established “a pivotal principle in First Amendment jurisprudence — that the government cannot, in the name of shielding minors from supposedly objectionable content, implement a blanket ban on that content and thereby reduce the scope of speech available to consenting adults.”

Kohli initially “sought a direction to the Bureau of Police Research and Development (BPRD) to study the link between free access to internet pornography and child sexual abuse cases as well as rape,” The Hindu noted.

Kohli withdrew his petition following the Supreme Court rebuke.

Evil Angel Brings Scarlet Chase's SecretCrush to DVD/VOD

LOS ANGELES — Evil Angel will release Scarlet Chase’s “I’ll Be Your Latex Slave,” the latest title from her SecretCrush brand, on Wednesday, Sept. 21.

The title features Chase in six fetish scenes, including “perverse fun, from a pussy squirt facial to anal domination to machine-powered dildo drilling, and all of the fetish-and-fucking action comes wrapped in tight, shiny latex,” said a rep.

“I’m so excited to be releasing my first DVD and VOD with Evil Angel, especially with it being focused on latex,” Chase said. “Latex has always been a huge fetish of mine. I love the way it feels and looks, hugging and restricting the body so tightly. These scenes in particular are some of my favorites. I can’t wait to share them with my fans, as well as a lot more latex scenes to come.”

The title is the first release under an expanded agreement between Evil Angel and SecretCrush, explained Evil Angel Head of Business Development Magalie Rheault.

“Scarlet’s SecretCrush brand was already highly popular on fan sites as well as tube sites when she started working with Evil Angel last year,” Rheault said. “She created exclusive scenes for EvilAngel.com, and her popularity among site members rose to the roof. Following the success of her scenes, we decided to add DVD, VOD and broadcast distribution to our partnership.”

Magic Wand’s ‘Pleasure as Art’ Sculpture Now on View at the Erotic Heritage Museum

LAS VEGAS — Vibratex and Las Vegas’ Erotic Heritage Museum presented artist Dafne Blade’s “Pleasure as Art” Magic Wand sculpture earlier this month.

Vibratex, sole North American importer of the Magic Wand brand, commissioned Blade to create the “Pleasure as Art” sculpture piece in 2021.

The “Pleasure as Art” contest winning sculpture will remain on display at The Harry Moheny Erotic Heritage Museum in Las Vegas through the end of October.

The sculpture makes use of 100 decommissioned wands and features an original painting that Mashable referred to as “not only stunning, but evocative of ‘Game of Thrones.’”

Addressing attendees at Las Vegas’ Erotic Heritage Museum at the Sept. 3 event, artist Dafne Blade offered an intimate look into their transformative experience developing the Magic Wand sculpture.

The audience included industry vets, academics, artists and museum goers, who listened to presentations about Blade’s personal journey and about the art piece’s evolution from concept to creation.

Blade’s presentation was preceded by a historical retrospective from Dr. Lynn Comella, author of Vibrator Nation and Professor of Gender and Sexuality Studies at UNLV.

Comella shared stories and examples of Magic Wand’s impact on society, noting that Blade’s creation was now part of that history.

A National Competition for Magic Wand Sculptures

Blade was the winner of a national competition that called on artists to design art using 100 inactive Magic Wands.

“I saw the competition notice and there was only one week before the deadline to submit,” Blade shared with event attendees. “I knew this was exactly what I wanted and needed, so I called my job and told them I wasn’t coming in that week.”

Blade presented slides of their contest entry, which they’d submitted with just minutes to spare, along with a host of photos of the entire design and construction process – one that involved their whole family.

In order to stay on schedule, Blade called on their parents and siblings to help with construction of the massive sculpture.

“Dafne’s presentation was as fascinating as it was moving,” explained Shay Martin, owner of Vibratex and CMO of the Magic Wand brand. “It was such an amazing story, and I’m thrilled to have Dafne and their art as part of our brand’s legacy.”

Magic Wand intends to share details of the sculpture’s continued tour, as well as the release of images and video of Blade’s touching presentation, in the near future.
