Lawsuit Sponsored by Anti-Porn Lobby Aims to Shut Down Las Vegas' Sapphire Club

LAS VEGAS — Religiously motivated anti-porn and anti-sex-work lobby NCOSE has filed a lawsuit aiming to shut down one of Las Vegas’ premier strip clubs, Sapphire Las Vegas.

The lawsuit also targets the Chicken Ranch, an unrelated full-service sex work establishment. The suit is part of the well-funded Washington, D.C.-based conservative group’s campaign to challenge all legal sex work in Nevada.

NCOSE, formerly known as Morality in Media, announced in an Aug. 31 statement that its lawsuit against Sapphire and the Chicken Ranch had been allowed to proceed by the U.S. District Court, District of Nevada.

“In the lawsuit filed by the National Center on Sexual Exploitation Law Center (NCOSE) and Jason Guinasso, an attorney with Hutchison & Steffen, PLLC,” the NCOSE statement read, “the plaintiffs, Jane Doe #1 and Jane Doe #2, are seeking to hold the defendants responsible for protecting the sex trade and enabling sex slavery, in violation of the 13th Amendment and the Trafficking Victims Protection Reauthorization Act.”

NCOSE alleges that plaintiff Jane Doe #2 “was sex trafficked in Nevada through legal strip clubs, including the Sapphire Gentleman’s Club,” and NCOSE’s senior legal counsel, Christen Price, stated her belief that “prostitution is rife in these legal entities, and under federal law it is sex trafficking.”

Conflating all legal sex work with “sex trafficking” has been one of the key strategies used by NCOSE in its ambitious quest to outlaw all consensual sex work, one of the group’s core goals. NCOSE has seen its operational budget balloon in the last three years thanks to a surge in tax-free donations, enabling the organization to engage in “lawfare” by using civil litigation in pursuit of its political goals.

Originally, NCOSE also planned to sue Steve Sisolak, the governor of Nevada; Aaron Ford, the state’s attorney general; the city of Las Vegas; and Nevada’s Clark County and Nye County. However, the court ruled that the plaintiffs did not have standing to sue those parties.

NCOSE and its legal associate are appealing that ruling.

LOS ANGELES — The first scene of “Spideypool XXX: An Axel Braun Parody,” the director’s latest Wicked Comix superhero spoof, is now available on Wicked.com.

The scene features Gamma exclusive contract performer Seth Gamble reprising his award-winning role as Deadpool, paired with Kenna James as Mary Jane Watson.

The all-new production marks Braun’s first parody since helming last year’s award-winning “Black Widow XXX.”

In Marvel fandom, “Spideypool” is shorthand for the popular ‘slash’ teaming of Wade Wilson (Deadpool) and Peter Parker (Spider-Man).

“While Deadpool and Spider-Man’s relationship in the comic book canon has always been contentious, Wade is rarely all-out bad, and Peter always tries to see the good in people,” a rep noted. “These character traits have laid the foundation for a hilarious, if unlikely, superhero bromance in fan culture that’s inspired thousands of works of visual art and slash fiction — but never in a live-action film.”

Director and Wicked Head of Production Axel Braun said, “I feel so lucky. I get to play in a sandbox with all these characters I love, and I can do things that mainstream is not allowed to — and I’m not just talking about the sex. Deadpool is an R-rated character, while Spidey is PG-13, and toning either down or up would totally alienate their core audiences, so they simply can’t make a Spideypool movie.

Return of the ‘Marvel AxelVerse’

Spideypool XXX features many recurring members of the Marvel AxelVerse, beginning with Gamble, returning to portray Deadpool for the fourth time.

“I’m a huge fan of Ryan Reynolds as Deadpool,” Braun said, “but Seth Gamble, to me, is the definitive version of Wade Wilson. He took this role and instead of simply doing an impersonation of Ryan he morphed it into his own by studying the comics to a degree where he could quote specific page numbers.”

Gamble enthused, “Reprising my role as Deadpool is always a blast. This is my fourth time getting the opportunity to dig into being the merc with a mouth and I have to say that ‘Spideypool XXX’ is by far the funniest movie I’ve ever done.”

Co-star Kenna James described working on ‘Spideypool XXX’ as “everything I could have hoped for and more. It’s incredibly funny and it could not have been a more perfect cast. Hands down, my favorite part about the first scene is I get to fuck Deadpool, that’s literally the dream.”

James added that Gamble “is such an amazing scene partner, but this is definitely a new level of amazing — one of the best scenes of my entire career.”

SAN FRANCISCO — Attorneys for the former owners of Backpage.com and for the federal government presented arguments this morning before a three-judge Ninth Circuit Court of Appeals panel, in the defendants’ appeal of a lower court’s denial to dismiss the case.

Attorneys for former Backpage.com owners Michael Lacey and Jim Larkin, led by First Amendment expert and noted adult industry attorney Paul Cambria, continue to seek a dismissal due to double jeopardy, after the pair’s first trial ended catastrophically for the government in a mistrial due to prosecutorial misconduct.

The oral arguments before judges William A. Fletcher, Jay Bybee and Lawrence Vandyke were broadcast live from the Ninth Circuit Court of Appeals website this morning.

Stephen Lemons, editor of the Lacey and Larkin-associated website Front Page Confidential and the leading authority on the case, told XBIZ that today’s arguments “revealed, yet again, the tenuousness of the prosecution’s case.”

The government, Lemons added, “wants to pretend the Lacey and Larkin case has nothing to do with speech. It’s all about speech — legal speech that the government has suppressed. My hope is that the Ninth Circuit can put an end to this travesty.”

Today’s oral arguments come a year after controversial Judge Susan Brnovich — wife of Arizona Attorney General Mike Brnovich, who is currently campaigning for a U.S. Senate seat — declared a mistrial in the case against Lacey and Larkin.

As XBIZ reported, the mistrial ruling came after prosecutors repeatedly ignored Judge Brnovich’s instructions not to attempt to prejudice the jury by bringing up unrelated and inflammatory “child sex trafficking” insinuations.

“The trial judge declared a mistrial in September 2021 due to prosecutorial misconduct,” Lemons told XBIZ at the time. “The defense moved for dismissal, arguing that a new trial would violate the Fifth Amendment’s bar on trying someone twice for the same crime.”

Lemons explained that a new judge “denied that motion without holding an evidentiary hearing. The defense has appealed to the Ninth Circuit.”

LONDON — The U.K.’s Conservative government today reversed a longstanding position by vowing to “crack down on porn sites,” and selectively enforce controversial legislation by targeting four high-profile tube sites, including Pornhub and xHamster.

The Information Commissioner’s Office informed the press about the surprising policy reversal by the beleaguered Tory government, currently without clear leadership since Prime Minister Boris Johnson announced his resignation over a variety of controversies.

The ICO is currently headed by a conservative lawyer from New Zealand, John Edwards, who previously served as his home country’s privacy commissioner.

The Times described Edwards as “a vocal critic of social media,” noting that he once called Facebook “morally bankrupt pathological liars.”

Under Edwards, Bloomberg reported, the ICO “has pledged to crack down on porn sites and other adult-only services to ensure they are taking steps, such as verifying users’ ages, to prevent children’s access.” 

Previously, ICO policy had established that “services aimed at adults weren’t subject to the ‘Children’s Code’ or Age Appropriate Design Code, a set of rules that guide how the UK Data Protection Act should be applied to digital services for children,” Bloomberg explained.

The Baroness Kidron’s ‘Children’s Code’

As XBIZ reported, the “Children’s Code” was drafted by a former film director and British noblewoman, the Baroness Beeban Kidron, who recently succeeded in exporting her vague-yet-strict notions of putting “guard rails” and “safety belts” on the internet to the California legislature in the form of a new age verification bill.

Kidron is a 62-year-old former photographer, film producer and director, philanthropist and self-appointed “advocate for children’s rights in the digital world.” She has founded and chairs charities the 5Rights Foundation and Into Film. She is an unelected “life peer,” legislating in the U.K. as a member of the House of Lords Democracy and Digital Technologies Committee.

Today, Edwards’ ICO announced that it is expanding deployment of the Children’s Code, following “a challenge from eleven civil society groups in December 2021,” Bloomberg reported. “Those groups, including the NSPCC, Barnardo’s, and CHIS, argued that the wording of the code covers all services ‘likely to be accessed’ by children and not just services aimed at children. The groups said that allowing children to access adult-only services poses data protection harms in addition to content harms.”

“We have revised our position,” Edwards said today. “We now accept that if there are a significant number of children accessing the sites they are in the aegis of the code.”

Selective Threat to Specific ‘Porn Sites’

The ICO has said that it will specifically target “adult-only services,” starting with Pornhub and xHamster, to “make it clear that they must comply with the code by preventing children’s access.”

According to Bloomberg, Edwards said that “if a company can show their services are not accessed by a significant number of children, they would not be subject to the code.”

As of now, neither Edwards nor the ICO nor the Children’s Code has spelled out what threshold marks a “significant” number of children, or what method should be used to ascertain such a number.

The ICO additionally stated that “it has been investigating four companies for non-compliance with the code, and auditing an additional nine,” Bloomberg reported. “A spokeswoman declined to name any of the 13 companies.”

Edwards claimed that he had worked with mainstream platforms like Instagram, Facebook, YouTube and Google to “make voluntary changes to children’s accounts to comply with the code,” with the result that “children are better protected online in 2022 than they were in 2021.”

Edwards pointedly left out Twitter and Reddit, which still tolerate adult content and have been targets of War on Porn crusaders pressuring the companies to censor what they consider “pornography.”
