SACRAMENTO — The California Office of the Small Business Advocate (CalOSBA) yesterday began distributing the sixth and final round of COVID relief business grants, which will last until Tuesday at 5 p.m., but the application still includes a “prurient clause” which discourages adult businesses from applying.

CalOSBA promotes through their website that this funding round has eligible grant awards of $5,000 to $25,000 and it is intended for “current waitlisted small businesses and/or nonprofits not selected in [earlier rounds] and new applicants that meet eligibility criteria.”

But among the “eligibility criteria” CalOSBA has copied the “prurient clause” found in the federal SBA loan application as a disqualification intended against adult businesses.

Under “Ineligible Businesses,” CalOSBA lists “businesses of a prurient sexual nature, including businesses which present live performances of a prurient sexual nature and businesses which derive directly or indirectly more than de minimis gross revenue through the sale of products or services, or the presentation of any depictions or displays, of a prurient sexual nature.”

An Antiquated, Discriminatory Term

As XBIZ has been reporting, the “prurient” clause on the SBA loan replicates mid-1990s language designed to discriminate against sexually oriented businesses.

The word “prurient” is an imprecise, obscure word that means “appealing to unhealthy sexual interests” and was used by the U.S. Supreme Court in a landmark 1973 ruling. Several members of the adult entertainment community and First Amendment lawyers have pointed out that people who do not consider their sexual expression “unhealthy” are exempt from application of the “prurient” clause.

Last year, several sexually oriented businesses across the country sued the SBA for discrimination regarding the “prurient clause.”

XBIZ has repeatedly contacted the CalOSBA public information officer regarding the appearance of the federal language on the State form, but we have received no reply at the time of publication.

Businesses that do not consider themselves “prurient” are encouraged to apply here until Tuesday at 5 p.m. (PDT). Notifications of the awarded grants will begin Friday, May 7.

LOS ANGELES — Jessica Drake, sex educator, Wicked Pictures contract star and brand strategist for Wicked Sensual Lube, was a featured speaker at Tending the Garden’s virtual “Summit for Healing” this week.

Described by a rep as “a healing retreat for survivors of assault founded by sex educator and trauma expert Jimanekia Eborn,” the two-day summit was designed to “bring healing and accessible space to survivors of sexual assault, particularly those of marginalized identities.”

The event, noted the rep, provided participants with access to licensed therapists, counselors, sex educators and “fellow survivors” through a series of panels and discussions. “Jessica spoke alongside licensed clinical social worker Angie Gunn and veteran sex worker, community organizer and Black feminist pornographer Sinnamon Love on the panel ‘Being a Sex Worker and a Survivor.'”

Drake observed how the summit “created a safe space for very necessary and yet often overlooked conversations about the intersection of survivors and people with marginalized identities.”

“Not only was I honored to speak as a panelist on ‘Being a Sex Worker and a Survivor’ along with Sinnamon and Angie, I also attended the entire summit and learned so much from each of the panelists,” she added. “As a survivor, finding new ways to heal and feeling a sense of community are so important, and I highly recommend everything Jimanekia and Tending The Garden have to offer.”
