PHUKET, Thailand — As more Thais have opened OnlyFans accounts to support themselves during the pandemic, legal experts in the Southeast Asian kingdom are warning about the uncertain status of the content produced given their notoriously harsh obscenity laws.

Like several mainstream papers around the world, the Bangkok Post recently published a profile of local people who had entered sex work for the first time during the pandemic, after opening an account on the popular premium service.

But in Thailand, the report explained, publishing “obscene” content online is “punishable by up to five years imprisonment, a B100,000 fine, or both.”

“Furthermore, as pornography is considered by law to be a disruption to peace in society, anyone can file a complaint with relevant authorities,” the Bangkok post continued.

One of the content creators, profiled anonymously, argued that, although he “wasn’t opposed to legal controls over pornography in public spaces,” OnlyFans is a “controlled and closed” space and therefore “creators shouldn’t be prosecuted — instead, they should be granted privacy and intellectual property right protection.”

The creator said that since OnlyFan requires age-verification, it is then “consumed in limited circles” and therefore should be protected from copyright violators.

Thai Law and ‘Unlawful, Obscene’ Material

But the paper also consulted legal expert Natchapol Jittirat, a lecturer at Chulalongkorn University’s Faculty of Law, who said “adult content creators cannot demand protection under the law when their photos and videos are unlawfully disseminated by others, as under Thai laws, the content is considered ‘obscene’ material.”

Jittirat added creators in fact “risk being prosecuted under existing laws.”

And although some people may consider OnlyFans “a private space,” Jittirat opined that “the courts will still consider it to be a public space, as the platform can be easily accessible by anyone with access to the internet.”

“If they want to be safe from legal action, they will have to do it outside the Thai courts’ jurisdiction and the content must not have any consequences in the kingdom,” he added.

Tourist Content and Online Crackdown

A year ago, as XBIZ reported, the arrest and public shaming of an American man and his Hungarian partner in Thailand for “overstaying in the country, publishing pornography and working without a permit” shed a spotlight on a little-talked-about issue among self-producers: the dangers of shooting pornography while traveling as a tourist.

Then, last November, the military party that took over Thai government after a coup announced it was cracking down on adult content and banning access to Pornhub, one of the nation’s most-visited sites.

Although anti-censorship groups protested the measure, Thailand’s Digital Economy and Society (DES) Minister Buddhipongse Punnakanta accused Pornhub of “hosting illegal material from hidden recordings to non-consensual pornography, as well as sexual abuse of children, which obliges the ministry to block it.”

Pnnakanta added his ministry was “looking into complaints against other porn websites and will block them, adding the authorities have taken similar action against illegal gambling websites.”

LOS ANGELES — The Daily Beast published an opinion piece today by Cherie DeVille giving her personal testimony about how the current religiously motivated War on Porn is warping the public opinion against sex workers who work in the industry.

“Every morning for two months, hordes of people have misidentified a group of professionals as part of a global pedophile conspiracy,” wrote DeVille, the 2021 XBIZ Award winner for “MILF Performer of the Year.”

“I’m not talking about conspiracy theorists falsely accusing Comet Ping Pong’s pizza delivery guy,” she said. “I’m discussing the aftermath of the New York Times’ Nicholas Kristof, religious fire-breathers, famous feminists and tech reporters painting the porn industry as a sex-trafficking racket.”

As XBIZ has extensively reported, Kristof’s December 4, 2020 editorial “The Children of Pornhub” was crafted to emotionally exploit the testimonies of victims of alleged sex crimes in order to justify an all-out, religiously motivated attack on Pornhub, adult tube sites and the adult industry in general.

Two major anti-porn groups, NCOSE (formerly Morality in Media) and Exodus Cry have taken credit for Kristof’s article and the campaign it launched with politicians and business leaders.

DeVille’s Daily Beast article accurately describes the intentional damage to law-abiding adult creators caused by the New York Times’ piece.

“In December, Kristof wrote a horrifying viral story about unverified users uploading child pornography and rape videos onto Pornhub,” she wrote. “You probably know what happened next: Pornhub banned unverified users, and Visa and Mastercard suspended payments on Pornhub. Everyone from MAGA senator/insurrectionist Josh Hawley, to liberal, feminist tech journalist Kara Swisher, to edgelord podcasters Dasha and Anna praised big finance for taking on ‘Big Sex Trafficking.'”

Like the overwhelming majority of people in the adult industry, DeVille points out that she, too, “would like to take on Big Sex Trafficking because sex trafficking disgusts me. I would like to abolish the racket, but I have zero ideas on stopping sex trafficking because I don’t work as a sex trafficker. I’m a consenting adult performer working in the highly regulated, legal porn business. If sex trafficking occurs in legal porn, I have yet to see it — and I’ve worked in the adult business for a decade. I’ve sold my self-made content on every legal clip site you can imagine, and I’ve shot for every major porn studio — which, not to brag, is a pretty big deal.”

Kristof’s Article ‘Harmed’ Adult Creators

DeVille then goes on to spell out how “the Times story’s aftermath has harmed legal porn stars and done little to nothing to stop sex trafficking.”

“The world has moved on to other viral stories, but porn stars are still reeling from the consequences of Kristof’s sloppy report,” she added.

DeVille, however, allows for the possibility — unlikely as it may appear — that Kristof may not be a willing accomplice to the War on Porn crusaders he so blithely elevated.

“To a degree, I understand why Kristof is confused,” she wrote. “Midway through his story, he identifies Traffickinghub founder Laila Mickelwait as a source. I would be confused, too, if I learned everything about porn from Mickelwait. She also works for an evangelical Christian organization called Exodus Cry. The group emerged out of Kansas’s radically conservative [International House of Prayer]. As the Daily Beast previously reported, IHoP promoted homophobia in Uganda, where legislators later attempted to pass a law sentencing homosexuals to life in prison. (I never thought I would see the day when landmark lesbian tech reporter Swisher would push propaganda from a group in league with Christian preachers trying to throw gay women and men in prison, but here we are.)”

“Now many people are pushing Exodus Cry’s lies, unaware of Exodus Cry’s background,” DeVille correctly noted. “If Exodus Cry wanted to end sex trafficking, they would target Facebook, where victims’ advocates say more sex trafficking occurs. But for the past decade, Mickelwait has tried to abolish porn altogether.”

SAINT-JOSSE-TEN-NOODE, Belgium — Belgium’s Psychologencommissie/Commission des Psychologues, the governing body of the European kingdom’s psychology profession, suspended sex expert Kaat Bollen after deciding that her choice to direct a pornographic film, and her sharing of what they deemed “indiscreet photographs,” damaged “the dignity of their profession.”

Faced with this blatant case of stigmatizing sexual expression, last month Kaat Bollen gave up her professional license of her own volition.

According to a report by Vice, “critics are calling the decision a backwards and misogynistic move that polices Bollen for what she chooses to wear and do in her personal life, and effectively amounts to slut shaming.”

Bollen is described by Vice as “a well-known personality within the Benelux media, where she often appears to discuss issues surrounding sex and relationships.” She’s also the author of three books on sex education.

Bollen is also the director of the 2017 adult film “A Girls’ Getaway,” marketed as “porn for women,” which is available via adult streaming platforms.

An Anonymous Informer

In early 2020, Vice reports, “an unknown colleague reported her to the Belgian Commission of Psychologists, an independent organization responsible for handing out all official practicing licenses in the country.”

“In March 2020, a special disciplinary committee heard the case and ultimately decided against Bollen, resulting in an official warning.”

Bollen appealed, and almost a year later, last January, the Psychologencommissie/Commission des Psychologue has temporarily suspended her professional license.

According to excerpts of the verdict published by Belgian TV station VRT, the committee decided that Bollen’s activities as a pornographer and public figure resulted in “the dignity of their profession being affected and their image damaged.”

The adult film, Bollen’s social media activity and her ownership of an online pleasure products store were used as basis for the suspension.

Bollen reacted by surrendering her license.

Sexual and Professional

“Why is sexy and/or feminine not worthy?” Bollen wrote in response to the decision of the Commission. “And since when do we psychologists judge the dignity of others? Shouldn’t we have an open mind and encourage authenticity? Since when should we as psychologists have to be more worthy than others? Aren’t we just people trying to be there for other people? Is our strength as a psychologist not precisely in being human and the encounter between two real people?”

“If being a psychologist in 2021 means that I cannot be myself — not even in my private life, because that is what this is about! — then I would rather not be a psychologist,” she added.

The Flemish Minister of Equal Opportunities, Bart Somers, said he would intervene.

“As Minister of Equal Opportunities, I’m going to discuss this with the psychology committee next week,” he said in January. We don’t need a clothing police here.”

The attempt to shame Bollen resulted in a grassroots social media campaign, where Flemish women posted pictures of themselves — labeled “Feminine. Sensual. Sexual. Professional” — with the hashtag #IstandwithKaat.
