PHILADELPHIA — A 3rd Circuit Court of Appeals ruling that a lower court should not have dismissed a case against TikTok has revived concerns about the protections afforded by Section 230, the so-called “First Amendment of the internet.”

The 3rd Circuit ruled that the algorithmic recommendations on TikTok’s For You page constitute an “expressive product” that “communicates to users” that a “curated stream of videos will be interesting to them,” tech news site Ars Technica reported.

Citing a recent Supreme Court ruling, 3rd Circuit Judge Patty Shwartz ruled that a platform’s algorithm reflecting “editorial judgments about compiling the third-party speech it wants in the way it wants” is “not protected by Section 230, which only shields platforms from liability for third-party speech, not platforms’ own speech.”

Under Section 230, internet platforms that host and moderate user-generated content — including adult content — cannot generally be sued for that content. However, Section 230 is not absolute. Writing in 2022, digital rights advocates Evan Greer and Lia Holland of advocacy group Fight for the Future noted, “It does not provide immunity if the platform develops or creates the content, and it does not provide immunity from the enforcement of federal criminal laws. But, crucially, it does protect against criminal liability from state laws.”

The plaintiffs suing TikTok argued that the platform’s For You page recommended a “Blackout Challenge” video to a child, who then tried the stunt and died.

“This is, of course, horrifying,” wrote Techdirt’s Mike Masnick, who regularly reports on free speech online and Section 230. “But who is to blame?”

Masnick explained that in order to reach its conclusion, the 3rd Circuit “had to intentionally reject a very long list of prior case law on Section 230, misread some Supreme Court precedent, and (trifecta!) misread Section 230 itself.”

“This may be one of the worst Circuit Court opinions I’ve read in a long time,” Masnick added. “It’s definitely way up the list.”

For Masnick, the decision “basically overturns Section 230 for an awful lot of publisher activity.” 

“I would imagine (hope?) that TikTok will request an en banc rehearing across all judges on the circuit and that the entire Third Circuit agrees to do so,” he wrote. “At the very least, that would provide a chance for amici to explain how utterly backwards and confused this ruling is.”

SYDNEY — After New South Wales state authorities announced earlier this month plans to hold an inquiry on the impacts of “harmful pornography,” researchers on the prestigious Australian academic site The Conversation have questioned the blatantly negative framing of the project.

New South Wales Attorney General Michael Daley has requested that a parliamentary committee “look into and report on the impacts of violent and misogynistic pornographic material on mental, emotional and physical health,” Australia’s ABC News reported.

“A generation of young men are growing up with unprecedented access to the online world, and this includes early and easy access to pornography, with harmful depictions of the treatment of women,” Daley told the press on Aug. 2. “This inquiry will for the first time in our state provide insight into the full impacts of harmful pornography online and young people’s access to it.”

This week, Giselle Woodley and Lelia Green of Edith Cowan University, whose research is part of the Australian Research Council (ARC) Discovery Project “Adolescents’ perceptions of harm from accessing online sexual content,” published an article on The Conversation noting that “the negative framing of the inquiry risks revisiting old arguments, rather than advancing the debate and policies.”

According to Woodley and Green, although politicians, the mainstream press and vocal anti-porn and anti-sex-work activists have centered the debate around the potential harm to teenagers, “very few people have interviewed teens about it.”

“As part of our research, we asked teens about their experiences of porn and found many have a nuanced understanding of the risks, but also the benefits,” they wrote.

Woodley and Green’s research showed that, contrary to the biases of anti-porn activists as filtered through politicians and the media, “teens hold very mixed views about both porn and sexting” and “some of these views were positive.”

Porn, the authors also found, “may offer more accessible and explicit representations of sex and bodies that schools cannot.”

The authors recommend that policymakers and researchers “listen to teens, giving more importance to their firsthand experiences over secondhand statements. Secondhand statements tend to repeat warnings teens hear from others. Their actual experiences may be different from those represented in the media.”

COLUMBIA CITY, Ind. — Conservative activists in Indiana started a campaign to remove an elected official after a Midwestern right-wing news blog outed her as an OnlyFans model and published several screen captures from her members-only premium content account.

The campaign to destroy Etna Troy Township Trustee Elaine Western’s political career originated with the reporting of local news site Real News Michiana, which first outed her as a sex worker in April and is now amplifying the attempts to remove her from her elected position.

The moralistic witch-hunt, seeking to taint Western’s professional activities by stigmatizing her sex work, has resulted in “a petition to have her censured, investigated and removed from her post,” Real News Michiana informed this week.

“Earlier this month, the petition received enough signatures to be sent along to the Whitley County GOP for consideration,” the right-wing blog added, noting that “it’s unclear if there are truly any legal remedies to have her removed short of a resignation.”

In April, Western told the site, ““I haven’t tried to keep it a secret. I’m not doing anything illegal. I have not comment.”

Western’s attorney wrote to the activists stating, “Your letter intends to intimidate Mrs. Western into resigning from office to avoid a public media circus. Therefore, I believe your letter and any continuing effort along this line could constitute a criminal offense of intimidation.”

Nationwide Right-Wing Campaigns to ‘Scarlet-Letter’ Sex Workers Out of Non-SW Jobs

Republican and conservative activists and operators, helped by right-leaning news outlets and journalists have targeted the livelihoods of a diverse number of individuals in several walks of life over their unrelated sex work. The smear campaigns have sometimes included the non-consensual dissemination of material that was only otherwise available on paywalled, members-only sites. 

As XBIZ reported, during the 2023 election cycle, the Virginia Republican Party sent a mass mailing to voters containing explicit screen captures from a Chaturbate cam show featuring Democratic candidate Susanna Gibson two weeks before a highly contested election for the 57th District House seat.

The GOP-mailed envelopes salaciously warned, “Do not open if you are under the age of 18,” and “Warning: Explicit material enclosed.” Gibson was originally outed as a Chaturbate cam performer by a Washington Post reporter who wrote fawningly about Virginia Republican Gov. Glenn Youngkin, in a salacious exposé that political observers believed to be a smear operation set up by Gibson’s Republican opponents.

More recently, a campaign by conservative academic authorities egged on by Rupert Murdoch-owned publications resulted in disciplinary actions and a process of tenure removal against veteran University of Wisconsin-La Crosse professor of communications Joe Gow, who created erotic content for OnlyFans with his wife and occasionally also with adult performers.
