RALEIGH, N.C. — The North Carolina state legislature on Tuesday voted to override Gov. Josh Stein’s veto of a bill imposing regulations that industry observers have warned could push adult websites and platforms to ban most creators and content.

As XBIZ reported after the North Carolina state legislature passed HB 805, titled the “Prevent Sexual Exploitation of Women and Minors Act,” the bill — now state law — includes a requirement to verify performers’ ages and consent via a process that significantly exceeds federal record-keeping requirements under Section 2257.

It also mandates explicit written consent for each individual sexual act in which a performer engaged during the creation of the content, as well as separate consent for distribution of the content.

Further, under the new law, anyone appearing in adult content is entitled to withdraw their consent at any time, regardless of any legal contract they might have signed. The site or platform is then required to remove the content.

Industry advocates and stakeholders have warned that new law could create havoc in the adult industry by requiring an inaccessible level of documentation for previously published content and by effectively invalidating model contracts.

As XBIZ reported earlier this month, Gov. Josh Stein vetoed the bill — though his veto message revealed that his opposition to HB 805 had little to do with protecting the First Amendment rights of adult websites, and more to do with tacked-on provisions unrelated to the adult industry. Those provisions include sections targeting transgender rights and enabling parents to block school libraries from lending their children books of which they do not approve.

While the original votes on the bill fell short of the margin required to override a veto, legislators on Tuesday were able to summon up the requisite three-fifths of legislators in each house in order to override the governor’s veto, making the bill into state law.

LONDON — Virtual private network apps, which can be used to circumvent geo-specific age verification requirements, are topping Apple App Store downloads in the U.K. in the wake of new Online Safety Act rules, the BBC is reporting.

As XBIZ reported last week, July 25 marked U.K. media regulator Ofcom’s deadline for user-to-user services such as tube, cam and fan sites to implement its requisite “highly effective age assurance” measures for preventing minors in the U.K. from viewing adult content. The rules also impact mainstream platforms that host online content, such as X and Reddit.

In April, Ofcom stated that providers of online pornography were already implementing age assurance across “thousands of sites” accessible in the U.K. in response to Ofcom’s OSA enforcement program. Pornhub is among those implementing AV measures compliant with OSA requirements.

According to a BBC report, half of the top 10 free apps in Apple’s U.K. download charts “appeared to be” for VPN services as of Monday morning.

One app maker, Proton VPN, told the BBC it saw an 1,800% spike in downloads after the new AV rules took effect.

The use of VPNs to disguise IP address and/or physical location is common, including among users seeking to bypass requirements that platforms hosting adult content check the age of users in specific territories.

France experienced a similar surge in VPN signups after Aylo, which operates Pornhub, Redtube, and YouPorn, cut off access to those sites in the country in the wake of new age verification regulations.

Spikes in VPN use also occurred in Utah, Texas and Florida when Aylo blocked access to Pornhub in those U.S. states after each passed AV legislation. As a result, some state legislators have pushed for additional rules that would require adult sites to block VPN traffic, forbid covered platforms from relying solely upon the geographical registration of an IP address to determine a user’s location, or perform a geolocation check to “dynamically monitor” users attempting to access adult content.
