European Commission: Age Verification App Ready For Use

BRUSSELS — The European Commission’s age verification app is now technically ready and will soon be available for EU citizens to use in order to prove their age when accessing online platforms, European Commission President Ursula von der Leyen announced Tuesday.

In July 2025, the European Commission released its guidelines for protecting minors online under the EU’s Digital Services Act (DSA) and made public a “white label” age verification app intended to help sites and platforms comply with age verification rules under the DSA.

The app then entered a “pilot phase,” during which the software was tried out in a number of EU member states. Those countries incorporated the app in their digital wallets or published versions of it on app stores, customized to national needs — though privacy-preserving features cannot be modified.

Aylo, which operates Pornhub and other high-traffic sites, has been participating in that pilot program.

In her statement, von der Leyen called the app “a free and easy-to-use solution that can shield our children from harmful and illegal content.”

“First, it is user-friendly,” von der Leyen said. “You download the app. You set it up with your passport or ID card. You then prove your age when accessing online services. Second, it respects the highest privacy standards in the world. Users will prove their age without revealing any other personal information. Put simply, it is completely anonymous: users cannot be tracked. Third, the app works on any device — phone, tablet, computer, you name it. And, finally, it is fully open source – everyone can check the code. This means that our partner countries can also use it. This is very important, that this can be used by our global partners.

“But more importantly, online platforms can easily rely on our age verification app,” von der Leyen added. “So there are no more excuses.”

EU member states France, Denmark, Greece, Italy, Spain, Cyprus and Ireland are “frontrunners” in adopting the app, von der Leyen said.

“They are planning to integrate the app into their national wallets,” she noted. “I hope more Member States and private sector will follow so that every citizen can soon use the app.”

Von der Leyen cautioned that the Commission will have “zero tolerance” for companies that do not respect children’s rights.

“This is why we are moving ahead with full speed and determination on the enforcement of our European rules,” she said. “We are holding accountable those online platforms that do not protect our kids enough.”

As an example, European Commission Executive Vice President Henna Virkkunen cited the Commission’s recent actions against PornHub, Stripchat, XNXX and XVideos. Last month, a Commission investigation preliminarily found those platforms to be in breach of Digital Services Act provisions intended to shield minors from adult content.

“They simply do not have proper age verification tools in place to keep our children away from their adult content,” Virkkunen said. “As platforms do not have proper age verification tools in place, we came up with the solution ourselves.”

Virkkunen added that she is setting up an EU-wide coordination mechanism for EU accreditation of AV solutions, “to ensure that we continue to build one solution for the EU, not 27 different ones.”

“Our blueprint is open-source, and any private company is free to use the blueprint to develop innovative solutions,” Virkkunen added. “We only have two conditions: respect the privacy standard. And make sure we have the same technical solution everywhere in the EU.”

LONDON — The House of Commons has modified amendments to the U.K.’s pending Crime and Policing Bill, including provisions regulating “step” content, content featuring adults role-playing as minors, and performers’ ability to withdraw consent.

As XBIZ reported in March, the House of Lords, the U.K.’s upper house of Parliament, approved amendments to the bill that would invalidate talent contracts, and outlaw “step” porn and content in which adult performers appear to portray minors. However, there has been ongoing tension between the Lords and the government over the amendments, and last week, the government indicated that it was backing amendments that would somewhat limit their scope.

The House of Commons has now published its proposed changes to the Lords’ amendments, in accordance with the government’s position. Those revisions include:

Limiting the proposed ban on “step” content. Under the House of Commons amendments, depictions of incest involving blood relatives would be outlawed, but the “step” ban would apply only if a performer is portraying someone under the age of 18. The government has emphasized that this provision is meant to ensure that the law only criminalizes material that portrays sex that would be illegal in real life.

Limiting the ban on content depicting adults portraying children. The House of Commons amendments would adjust this ban so that only “sound or information associated with the image” can indicate that a character is under 16. This replaces broader criteria, under which elements such as costume and setting could indicate whether an adult performer is portraying a minor. The updated, more specific requirement appears to mean that only audible dialogue and/or titles and descriptions associated with content would constitute such evidence. A government memorandum posted Tuesday notes, by way of example, that the law is “not intended to criminalise a pornographic image of someone who is clearly an adult where the only marker of childhood is the fact that he or she is in school uniform.”

Replacing a plan to allow anyone appearing in adult content to withdraw their consent at any time. The House of Lords amendments would require sites to verify the age and consent of all performers, and to remove content within 24 hours if a performer withdraws their consent — regardless of whether they previously consented to publication of the content or signed a contract. Instead of that law, the House of Commons version would require the Secretary of State to conduct a review of providers’ age and consent verification procedures, and present the results to Parliament within a year. The Secretary of State would also be given new powers to intervene on this issue and regulate sites’ age and consent verification duties without further authorization by Parliament.

The House of Commons’ list of proposed amendments does not include any objections or changes to a House of Lords amendment that would outlaw “choking” content. The government has concurred with that plan.

The differences between the Lords and Commons versions of the Crime and Policing bill will need to be resolved during “ping pong” negotiations, as proposed changes go back and forth between the two bodies.

Final IRS ‘No Tax on Tips’ Rule Excludes Pornography

WASHINGTON — The Internal Revenue Service on Monday published final regulations on the “No Tax on Tips” provision included in the “One Big Beautiful Bill Act,” offering new tax deductions for tip workers but excluding revenue received for “pornographic activity.”

The new rule, titled “Occupations That Customarily and Regularly Received Tips; Definition of Qualified Tips,” states: “Amounts received for prostitution services and pornographic activity are not included in the definition of ‘qualified tips.’”

After President Trump signed the omnibus legislation into law last year, the IRS developed final regulations for implementing the bill’s provision allowing taxpayers in occupations that have “customarily and regularly received tips” to deduct up to $25,000 per year in tips on their taxes. Following a comment period, the IRS finalized a list of qualifying occupations, and tips that eligible taxpayers may claim as a deduction.

The official “List of Occupations That Receive Tips” includes “digital content creators,” and the new rule provides some guidance specific to that occupation. However, content creators would not be able to deduct tips for “pornographic activity” — a term the rule does not define.

The rule notes that several commenters objected to this exclusion and its vagueness.

“In addition to noting that certain pornography is legal, some commenters stated that pornography is protected First Amendment speech, that these businesses pay taxes, and that in fairness these businesses and their employees should have access to the deduction for qualified tips,” the posted rule reports. “One commenter suggested the prohibition be limited to activity that is unlawful under State or Federal law. Several commenters requested that the regulations define pornographic activity.”

The rule notes that the Treasury Department and the IRS “will consider whether to provide additional guidance regarding these exclusions.” In the meantime, the IRS “intends to interpret the occupations on the list in a fair and impartial manner consistent with their commonly understood meaning.”

Justification at Odds With Anti-Debanking Policy

According to the IRS, excluding pornographic activities is “intended to address the potential for greater noncompliance and abuse with respect to these activities and services.”

This language seemingly contradicts the Trump administration’s public stance toward regulatory discrimination on the basis of lawful business activities, strongly echoing past justifications for debanking industry professionals and companies based on subjective interpretations of “risk.”

As XBIZ reported last year, President Trump’s August 7, 2025, executive order on debanking prohibits banks, savings associations, credit unions or other financial service providers from restricting access to accounts, loans or other services on the basis of a customer’s lawful business activities “that the financial service provider disagrees with or disfavors for political reasons.”

Following that order, the OCC issued a report on debanking, in which it named adult entertainment as one of several sectors facing discrimination for engaging in activities contrary to banks’ “values.”

In March, Federal Trade Commission (FTC) Chairman Andrew Ferguson warned PayPal, Stripe, Visa and Mastercard against denying customers access to services based on lawful business activities perceived as high-risk. Earlier this month, the Office of the Comptroller of the Currency (OCC) and the Federal Deposit Insurance Corporation (FDIC) issued a final rule codifying the elimination of “reputation risk” as a criterion in their supervision of financial institutions.

It remains unclear, however, how much impact any of those actions will ultimately have on adult creators and businesses. The OCC, the FTC and numerous banks have failed to respond to requests for comment or clarification on this question — and the new IRS rule further illustrates that attitudes toward the industry within the Trump administration remain far from positive.

FSC Commentary Highlights Double Standard

The Free Speech Coalition on Tuesday published an overview of the new provisions by FSC member Katherine Studley of The Only Consultant, which provides tax and business consulting for industry professionals. The piece notes that the exclusion of adult creators resulted from the efforts of conservative and Christian organizations.

“No acknowledgement that these are legal businesses operated by legal workers who have been paying their taxes,” Studley writes. “The same businesses who are good enough to tax are apparently not entitled to the same tax relief as everyone else.” 

Studley also notes that adult creators can deduct tips from “a non-explicit presence.”

“Adult creators are not banned as a category of person and the tip is tied to the content,” she writes. “This is advantageous for creators operating across multiple platforms and producing mixed content.”

The “No Tax on Tips” policy was passed as a temporary four-year measure and sunsets on December 31, 2028. Its provisions could be revisited or updated at that time.
