9th Circuit Upholds Verdict Against Oregon College for Discriminating Against Former Adult Performer

SAN FRANCISCO — The Ninth U.S. Circuit Court of Appeals on Monday upheld a 2022 Oregon jury’s verdict in favor of Nicole Gililland, a former nursing student who sued her school for discriminating against her because of her adult performer past.

As XBIZ reported, the jury found the Southwestern Oregon Community College in breach of contract for derailing Gililland’s career and life after the school administration and instructors found out in 2017-2018 about her brief stint as an adult performer a decade earlier.

Gililland performed for adult studios for around 20 months between 2007 and 2009.

The jury awarded Gililland $735,417 in compensation for the economic damage inflicted on her by SWOCC staff, plus $1 million in punitive damages.

While it upheld the verdict and the economic damage compensation, the Ninth Circuit decision struck down the punitive damages.

The original trial followed a long process, protracted by the school’s reluctance to acknowledge wrongdoing, and vindicated Gililland in her claim that in 2017 an SWOCC staffer told her she could not be a nurse because she was an “unclassy woman” and that records were altered to make her flunk out of the nursing program in which she had been excelling.

“This case has involved a lot of serious miscarriages of justice from the beginning,” Gililland told XBIZ in 2021. She has spent the last few years thriving as a law student, and has become involved in sex worker rights advocacy and activism during her years-long fight against her former Oregon nursing school.

‘This Isn’t Justice’

On Wednesday, Gililland told XBIZ that she was disappointed that the appeals court ruled against the noneconomic damages because according to Oregon precedent “emotional distress” damages are not recoverable.

The jury instructions, she said, asserted that noneconomic damages could include more than emotional distress, particularly “reputational harm.”

“You know, like for destroying my entire medical career with false accusations of being unsafe with patients, plagiarism — things I still have to answer for to this day and will have to forever,” Gililland — who is in the process of completing her legal training in Massachusetts — said. “I just had to submit a mountain of pages with my bar application. I’ll never get to be free of those transcripts or what they did. The jury got to consider more than emotional distress.

“I’m not upset about the money,” she added. “I’m upset I had to fight this hard, for this long, to win — they they still get away with it to a significant degree.”

At the time of the jury verdict, Gililland lambasted the SWOCC authorities for missing “every chance to show basic leadership and human decency every step of the way dealing with this clear-cut case of egregious discrimination.

“Instead, they chose to drag me and my family through a needlessly protracted process,” she added. “They decided to continue the victimization of a former sex worker instead of doing the right thing.”

After the appeals decision, Gililland continued questioning the handling of her case by SWOCC.

“They were able to get every other state insured college to join in an amicus brief that made this appeal about public policy instead of the facts of my case, and the facts are horrific,” she asid. “What’s even worse is the Defendants got away with this behavior year after year, and nobody that was obligated to, did anything to stop this behavior. I filed formal complaints that were not properly investigated, I had no choice but to sue. This could have gone any other way if someone in power had looked at the situation and told them to knock it off.”

Instead, she added, Oregon funded their defense at taxpayers’ expense, all the way through a trial and this appeal.

“What could be worse public policy than that?” she concluded. “Accountability to avoid lawsuits at all seems like the better rational. I was forced to sue, I was forced to take on a five-year fight, I was forced to rebuild from the ground up — literally from a homeless shelter — because of their bad acts, and I won. So yeah, this isn’t justice and it certainly isn’t good policy.”

Former Trump Staffer, Project 2025 Advisor John McEntee Predicts a Total Porn Ban

WASHINGTON —  John McEntee, Senior Advisor to the Heritage Foundation’s Project 2025 and a key figure in the former Trump administration, predicted an eventual full ban of pornography and claimed that once it is enacted, “this country will flourish.”

McEntee made these statements during an interview this weekend with right-wing broadcaster Michael Knowles. McEntee was promoting The Right Stuff, a “conservative dating app” he founded.

The full interview is paywalled, but progressive news site Meidas News published the excerpt on Tuesday.

Talking about the general topic of conservative men dating, Knowles brought up adult content.

“You bring up the elephant in the room, which is a stain on not only society but the entire dating culture as well — which is pornography,” McEntee proclaimed. “Whenever America bans that, which will be happening at some point, everyone will be much better off.”

“The minute that goes away, this country will flourish,” McEntee added.

Since 2023, McEntee has served as senior advisor for Project 2025, a coalition of conservative organizations led by the Heritage Foundtaion whose road map for the next Republican presidential administration includes a call to immediately outlaw all pornography and imprison people who produce and distribute it.

The introduction of Project 2025’s “Mandate for Leadership” blueprint document declares that pornography “has no claim to First Amendment protection” and should be outlawed.

“The people who produce and distribute it should be imprisoned,’’ the document continues. “Educators and public librarians who purvey it should be classed as registered sex offenders. And telecommunications and technology firms that facilitate its spread should be shuttered.”

The ‘Body Man’ in Charge of Staffing the Second Trump White House

The Heritage Foundation is currently scouting personnel for a potential upcoming administration under presumptive GOP nominee Trump.

McEntee, who served as director of the White House Presidential Personnel Office during the Trump administration, plays “a vital role supporting the personnel pillar of Project 2025,” the Heritage Foundation said through a statement celebrating his appointment. “Embracing the motto that ‘personnel is policy,’  Project 2025 is launching the database to collect résumés and vet thousands of potential applicants in advance of Jan. 20, 2025, when the next president takes office.”

McEntee boasted that the Project 2025 Presidential Personnel Database “will be of extraordinary value for the 47th president”  because the group is “doing a lot of the incoming administration’s most important work ahead of time” and vowed to “bring thousands of vetted, trained conservatives from across the country to Washington.”

McEntee was initially fired from his first White House position close to Trump in 2018, after it was revealed that he was under investigation by the Department of Homeland Security for serious financial crimes, CNN reported at the time.

Before his firing, McEntee had been one of Trump’s closest associates and “one of a select group of staffers who were often summoned by the President to the White House residence,” CNN reported, adding that during the 2016 campaign, McEntee served as Trump’s “body man,” which meant he was “nearly constantly at the President’s side.”

McEntee was rehired as director of the White House Presidential Personnel Office in Jan. 2020. He became extremely close to Trump — who calls him “Johnny” — in the last year of his presidency, including the period to the January 6 insurrection, leading The Atlantic to dub MacEntee “The Man Who Made January 6 Possible.”
