WASHINGTON — Democratic New York Rep. Alexandria Ocasio-Cortez issued a press statement last week prominently highlighting her partnership with religiously-inspired anti-porn lobby NCOSE, an organization that seeks to criminalize all sex work and eradicate adult content, and that has an extensive, well-documented history of championing state censorship and opposing LGBTQ+ rights.

The statement released by Ocasio-Cortez’s office celebrates her introduction of the Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024 (DEFIANCE Act), which proposes to create a federal civil right of action for victims of deepfakes.

The statement prominently features NCOSE, formerly known as Morality in Media, as the second in a long list of organizations endorsing the DEFIANCE Act, and closes with a full quote by NCOSE CEO Dawn Hawkins stating, “The proliferation of nonconsensual, sexually-explicit ‘deepfake’ images has exploded online, harming hundreds of thousands and threatening to harm anyone who has a photo online. It is past time that our laws catch up and hold the perpetrators of this abuse accountable! The DEFIANCE Act is a critical step forward allowing a path to some justice for survivors through civil remedies. This federal law will surely stop many abusers from creating this exploitive content!”

XBIZ contacted Ocasio-Cortez’s office and her Communications Director Sidney Johnson, for comment on whether the congressperson is aware of NCOSE’s history, past stances against free speech, promotion of censorship and opposition to LGBTQ+ rights. XBIZ also asked Ocasio-Cortez to comment on her partnership with Hawkins, a religious conservative activist who has spoken extensively about the Mormon roots of her War on Porn crusades and her efforts to rebrand Morality in Media as the more secular-sounding NCOSE.

After this story’s publication, Ocasio-Cortez’s Chief of Staff Mike Casca contacted XBIZ via X offering as the office’s official statement the following, “Bullshit. It’s not a partnership. She has a bipartisan bill to stop nonconsensual deepfake pornography that centers survivors’ civil right of action. Orgs left, right and center support it. Bipartishaship is how bills become law in a divided congress.”

Casca declined to answer any followup questions specifically abut NCOSE, particularly as to how the foregrounding of the anti-porn lobby — it’s listed second in a non-alphabetical list of more than thirty endorsing organizations and Hawkins’ quote is one of only two offered by any of those groups — constitutes “bipartisanship.” 

The Washington Blade Calls Out NCOSE

Earlier this week, Christopher Kane from LGBTQ+ politics site the Washington Blade also noted the peculiar alliance between NCOSE — which generally partners with religious Republicans for its campaigns — and Ocasio-Cortez, a notably progressive New York representative and member of “The Squad.”

Aides to Ocasio-Cortez did not respond to a request for comment from the Washington Blade, about how “the move appears to conflict with her history of supporting the LGBTQ community and reputation as one of its most loyal allies in Congress.”

Kane pointed out that although Hawkins’ quoted remarks “are inoffensive and germane to the legislation,” the NCOSE CEO has appeared insincere in the few statements she has made trying to backpedal her organization’s staunch opposition to LGBTQ+ rights since its creation in 1961 as pro-censorship, clergy-aligned group Operation Yorkville.

The Washington Blade listed repeated and recent incidents of NCOSE staffers and board members opposing LGBTQ+ rights. Kane also pointed out that the group is “primarily focused on opposing pornography,” a term that for NCOSE has included, in the recent past, the Sports Illustrated swimsuit issue and Cosmopolitan magazine.

LONDON — The Age Verification Providers Association (AVPA) filed earlier this month its response to U.K. media regulator Ofcom’s consultation soliciting feedback on the regulation of adult websites under Part 5 of the Online Safety Act.

“We were broadly supportive of their approach, but there is one major omission, the definition of ‘highly effective age assurance,’” the U.K.-based trade group explained through a statement.

Based on the work of experts developing international standards for the Institute of Electrical and Electronics Engineers and the International Organization for Standardization, AVPA’s response proposed that “highly effective age assurance systems must demonstrate that their certified expected outcomes are such that more than 95% of children under 18 are prevented from accessing primary priority content, and more than 99% of children under 16 are prevented.”

The group expressed concern that without expressing any opinion on the maximum acceptable false positive rate, “there will be a race to the bottom as sites which host primary priority content interpret the requirement as loosely as possible.”

Less accurate solutions, the group added, “are generally cheaper, and will also deliver a larger audience for sites whose commercial model is based on advertising and traffic volumes.”

AVPA questioned how Ofcom could potentially defend in court having acted against a site that “has deployed a solution which allows for up to 20% false positives, with perhaps 10% of them being more than 5 years below the age of 18, if the service provider has documented that that it considers this level of accuracy to be highly effective.”

Ofcom, the group stated, may argue that 20% is too great a level of error, “but would at that stage be forced to state what level is deemed sufficiently effective anyway.”

GENEVA, Switzerland — A World Intellectual Property Organization (WIPO) panel issued a decision on Tuesday, ruling against a Russia-based website operator accused of infringing on Clips4Sale’s intellectual property.

Clips4Sale’s attorney Corey D. Silverstein of Silverstein Legal had filed a WIPO complaint in January against Andrey Leonov, a webmaster based in the Russian Federation who registered the domain Clips-4-Sale.com last June.

The complaint alleged that Leonov was utilizing the domain to unlawfully offer competitive services that directly infringed on Clips4Sale’s intellectual property.

WIPO’s decision awarded the infringing domain to Clips4Sale, finding that “it was duly demonstrated that Respondent was aware of Complainant’s rights to the trademarks Clips4Sale and Clips4Sal.com at the time of the registration — as the evidence to the Complaint contains proof that the disputed domain name resolved to a website exposing content similar to Complainant’s website and including the trademark Clips4Sale aiming to divert internet users.”

The panel also held that the similar-sounding URL “exposes the likelihood of Respondent’s knowledge of Complainant’s trademark and a clear intent to take a free ride on Complainant’s renown.”

“We are very pleased with the panel’s decision,” Silverstein told XBIZ. “Clips4Sale will not hesitate to protect its intellectual property rights regardless of the location of any infringer. In this case, Andrey Leonov’s infringement was outright repugnant and the infringing domain was rightfully ordered transferred to Clips4Sale.

“Should Mr. Leonov or any other infringer engage in similar unlawful conduct, Clips4Sale will continue to exercise all of its legal options,” the attorney added.
