BRUSSELS — XVideos, Pornhub and Stripchat are reportedly suing the EU over their classification as “very large online platforms” (VLOPs), which make them subject to special regulations under the controversial Digital Services Act (DSA).

The lawsuit was first reported by European tech news site Euractiv on Thursday.

As XBIZ reported, the European Commission, the EU’s executive body, designated adult platforms Pornhub, Stripchat and XVideos as VLOPs in December.

The DSA classifies platforms that reach at least 45 million average monthly active EU users as VLOPs. The Commission officially stated that an investigation had determined that the three adult sites met that threshold.

At the time, Pornhub questioned the data the Commission had used to justify the measure.

“As of July 31, 2023, Pornhub has 33 million average monthly recipients of the service in the European Union, calculated as an average over the period of the past six months,” a Pornhub spokesperson told the New York Post.

An Aylo rep told Euractiv on Thursday that the company believes the designation happened “despite the extensive data and methodology explanations we provided to support our published figures. Therefore, we are exercising our right to take the legal route with our filing of an application before the General Court of the EU to annul the designation of Pornhub as a VLOP.”

“We will always comply with the law, including our obligations under the Digital Services Act, which we have been meticulously preparing for, and we hope that governments around the world will implement laws that protect the safety, privacy, and security of users,” the Aylo rep added. “We look forward to the facts being fully and fairly aired.”

HILLSBOROUGH, N.C. — Adam & Eve has released the results of a new survey asking Americans if they felt that Americans’ reproductive rights are being taken away.

Among poll respondents, 48% (44% of males and 50% of females) of those surveyed felt that their reproductive rights are definitely being taken away, another 23% (25% of males and 22% of females) said they feel they are somewhat being taken away.

Only 22% of the respondents (24% of the males and 22% of the females) did not feel their reproductive rights are being taken away. An additional 7% said they weren’t sure.

“Reproductive rights include having the ability to decide whether and when to have children,” said Dr. Jenni Skyler, resident sexologist at Adam & Eve. “It refers to the freedom to control decisions regarding contraception, sterilization, abortion, and childbirth. And as more of these rights are taken away, I encourage adults to vote to protect their reproductive and human rights as they see fit.”

Director of Marketing Chad Davis explained that Adam & Eve “got its start providing condoms by mail, and we still offer a wide variety of condoms to support easy access to affordable birth control. We encourage adults to explore their sexuality within their own comfort levels and boundaries.”

The web-based survey, conducted by an independent third party survey company, of over 1,000 American adults age 18 and up, was sponsored by Adam & Eve to study sexual preferences and practices.
