Another German Court Rejects Blocking Orders Against Pornhub, YouPorn

MAINZ, Germany — A German court has blocked the Rhineland-Palatinate Media Authority (MA RLP) from forcing telecom providers based within the court’s jurisdiction to cut off access to Aylo-owned adult sites Pornhub and YouPorn.

In a press release issued Thursday, the Rhineland-Palatinate Ministry of Justice revealed that the Administrative Court of Neustadt an der Weinstraße has upheld lawsuits filed by internet access provider 1&1 and by Aylo, opposing blocking orders issued by the MA RLP.

The MA RLP ordered DNS blocking of the sites in April 2024, on the grounds that they did not have sufficient age verification systems in place to prevent minors in Germany from accessing adult content, as required under the country’s Interstate Treaty on the Protection of Minors in the Media (JMStV). Aylo and 1&1 filed lawsuits in response.

The Administrative Court’s 5th Chamber has now upheld those claims, basing its ruling on two main factors: the primacy of the European Union’s Digital Services Act (DSA) law over the JMStV, and the “country of origin” principle in the EU’s Directive on Electronic Commerce, under which online services can only be regulated by the EU member states in which they are based. Aylo is legally based in Cyprus.

The Ministry of Justice statement notes that since the DSA entered into force in February 2024, there has been “a single, fully harmonized set of rules at EU level for the protection of minors in online media.”

“This regulation generally prohibits member states from imposing additional national requirements in areas already covered by the regulation,” the statement reads. “As the DSA already stipulates comprehensive due diligence obligations for online platforms to protect minors, it supersedes the previous German special regulations.”

The statement also notes that the European Commission has established exclusive jurisdiction in the matter by initiating its own proceedings against Pornhub and other platforms classified as “Very Large Online Platforms” under the DSA.

The Rhineland-Palatinate Media Authority is likely to appeal the ruling to the Higher Administrative Court of Rhineland-Palatinate — especially since that court previously ruled against Aylo on blocking orders.

Indeed, the issue has become a tangle of jurisdictional confusion. Not only have disparate German courts issued opposing rulings, but the issue of German versus EU law may not be as settled as this latest court ruling implies.

In September, an advocate general of the European Union’s Court of Justice advised the court, in a nonbinding legal opinion on a case involving WebGroup Czech Republic, which operates XVideos.com, and NKL Associates, which operates XNXX.com, that France may indeed require pornographic websites based in other EU states to implement age verification in accordance with French law.

The eventual conclusion of the Pornhub/YouPorn litigation in Germany is likely to be a precedent-setter, as the EU and national courts jointly hammer out which rules will take priority going forward.

LONDON — U.K. media regulator Ofcom on Thursday fined Kick Online Entertainment 800,000 pounds (more than $1 million) for failing to implement age checks as required for compliance with the Online Safety Act.

As XBIZ reported last year, Ofcom investigated a number of site operators to determine whether they had “highly effective” age checks in place to prevent minors from accessing adult content.

Following its investigation, Ofcom has fined Kick Online Entertainment 800,000 pounds for failing to comply with age check requirements between July 25 and Dec. 29, 2025.

In a statement on its website, Ofcom notes that the company has since implemented a method of age assurance that is “capable of being highly effective.”

In addition, Ofcom has fined Kick Online Entertainment 30,000 pounds (more than $40,000) for failing to respond to information requests “in an accurate, complete and timely way.”

The agency will impose a daily penalty of 200 pounds on the company until it responds, or for a period of 60 days, whichever is sooner.

Ofcom has also issued a provisional decision that Youngtek Solutions has failed to implement age checks and to respond to information requests. Meanwhile, the agency is expanding the scope of its ongoing investigations into four other adult companies over whether they have properly responded to information requests. Those companies are Fapello, Porntrex, Sun Social Media and XXBrits.

LOS ANGELES — The Free Speech Coalition (FSC) has laid out the legislative outlook for the industry in 2026.

We’re about six weeks into the New Year, and the legislative outlook for the adult industry is coming into clearer focus. While age verification still dominates the discussion and our fight, lawmakers have been pushing boundaries to find new ways to restrict, punish, or create liability for adult businesses. Below, a few key legislative trends:

Punitive Taxation
Utah and Virginia both introduced bills this year adding special taxes for adult content. The Virginia bill has been tabled until next year. If Utah passes its law, the state will join Alabama to become the second state to institute a content-based tax on adult speech.  

Consent Minefields
Arizona has moved rapidly on HB 2133, a new bill that would require complicated, contradictory documentation for any adult content uploaded online. As with the laws enacted in North Carolina and Alabama last year, Arizona’s bill, which requires every model release to be notarized, would make it impossible for adult businesses to operate in the state. 

VPN Restrictions
Michigan, West Virginia, and Wisconsin have both proposed significant VPN restrictions. While Michigan’s bill would ban VPNs entirely and is likely dead, the West Virginia and Wisconsin bills would require adult sites to identify and block all VPN traffic.

Warning Labels
Wisconsin, Washington, and Missouri have all introduced bills mandating warning labels on adult content. While FSC was able to secure an ongoing injunction against a similar law in Texas, our case is ongoing and Alabama’s health warning requirement remains in effect.

We are still early in the legislative calendar for many states, so we expect to see more of these bills introduced. While FSC is fighting these laws whenever and wherever we can, we are a relatively small organization with limited resources. As such, we must always prioritize where to concentrate our legal and legislative efforts. Some of those decisions are made based on our ability to effect change. However, with so many simultaneous fights on top of age verification, we are eager to hear from members to understand which laws pose the greatest threat to your businesses.
