FSC Files Legal Challenge to Louisiana Age Verification Law

LOS ANGELES — Free Speech Coalition (FSC) has filed a legal challenge in Louisiana over the state’s age-verification law.

The Louisiana law gives the state the power to fine sites with adult content up to $5,000 per day, which the trade organization argues is a direct violation of the First Amendment.

Joining Free Speech Coalition in filing the challenge are Elizabeth Hanson, a military veteran and spouse of an active-duty Coast Guard member residing in Slidell; Andrea Barrica, founder of the sex education site O.school; journalist, educator, and content creator Charyn “Ryn” Pfeuffer; and fan platform JustFor.fans. The parties are represented by Jeffrey Sandman of Webb Daniel Friedlander LLP and D. Gill Sperlein of the Law Office of D. Gill Sperlein.

“These laws give the state the power to harass and censor legal businesses,” says Alison Boden, Executive Director of Free Speech Coalition. “We, of course, support keeping minors from accessing adult content, but allowing the state to suppress certain speech by requiring invasive and burdensome systems that consumers refuse to engage with is simply state censorship.”

Seven states have passed laws requiring sites with substantial amounts of “material harmful to minors” to check users’ government ID or other age and identity verification information in order to access content. But consumers have been reluctant to do so, with more than 90% of users abandoning sites that comply with such laws. 

Last year, Louisiana passed a law allowing for a private right of action against adult sites without such age-verification for consumers, and other states followed suit. In June, Governor John Bel Edwards signed a new law give the government the power to fine sites directly — as much as $1M per year. 

“The First Amendment protects our right to freely access legal content and ideas without government interference,” says Jeff Sandman, a New Orleans-based counsel for the Free Speech Coalition. “We’re fighting not only for adult businesses but for the right of legal adults to use the internet without government surveillance. Showing your ID in a checkout lane is simply not the same as submitting it to a government database.”

“For decades, our industry has voluntarily and enthusiastically worked with filters that allow parents and others to easily block adult sites,” says Boden. “Those who wish to can do so easily, and the Supreme Court has ruled that this is preferable to government-mandated censorship. We are again asking the courts to reject these unreasonable and dangerous restrictions on a free internet.”

Roblox Debuts Age-Verified Adult Category, Allowing Graphic Violence But No Sexual Content

SAN MATEO, Calif. — Roblox has debuted a new games content category for users 17 and up, which includes select adult-oriented topics.

According to a Fast Company report, the new category will include “crude humor,” more graphic violence, “romantic themes and topics” as well as references to alcohol and to gambling.

The new adult category will not allow nudity and sexual content during its initial rollout.

Roblox’s Chief Product Officer Manuel Bronstein described the new category as a natural next step for the platform, noting that the platform user base has aged up. Users 17 to 24 now constitute 38% of daily active users as “the fastest growing population segment on the platform,” Fast Company reported.

“You can think about horror or action games that become a little more photorealistic,” Bronstein told Fast Company. “You could imagine that a game gets a little more realistic because in the city, they’re adding a casino or they’re adding a bar that you walk through and there’s some experience there.”

Fast Company said users 17 and up will be subject to a new age verification protocol to access the new category by uploading an image of an ID and a matching selfie. Roblox stated that they will not store the information after verification.

Bronstein added that users within the same household will have to use separate verified accounts.

British Baroness Defends Controversial California Age Verification Law She Inspired

HOLLYWOOD, Calif. —  The Baroness Beeban Kidron, a British aristocrat with California and Hollywood ties, was the subject of a fawning profile by Politico in which she continued to defend her controversial campaigns for internet age verification in the U.K. and California.

Politico — which is owned by high-profile, right-wing German press magnate Axel Springer — devoted a lengthy article last week about Kidron’s crusade to allow politicians and governments to regulate and police online speech with the vaguely defined mission of “protecting children.”

In the almost hagiographic article, titled “How a British Baroness Is Shaping America’s Tech Laws for Kids,” authors Mark Scott and Rebecca Kern allow Kidron to comment on an August 2022 XBIZ report that pointed out Kidron’s extensive professional and social relationship with convicted rapist Harvey Weinstein.

The authors of the article imply, without providing any evidence whatsoever, that XBIZ’s reporting of the lengthy association between Kidron and Weinstein was part of “lobbying” against the British aristocrat and her crusade against Big Tech.

“The lobbying became increasingly bitter,” they write. “Kidron became embroiled in barbed attacks, including viral online accusations — based on her decades-long movie career — that she had ties to disgraced producer Harvey Weinstein. She worked with him twice as a director but said she was not aware of his behavior that eventually led to his conviction on sexual assault and rape charges. Weinstein is appealing the charges.”

Politico links “viral online accusations” to an archived thread by XBIZ’s New Editor citing his article and including a photo agency photo of Kidron gleefully socializing with Weinstein.

“I do find it really interesting that, in their effort to stop products being designed with some sort of consideration of childhood, that they’re willing to go that low,” Kidron comments, without specifying to whom the conspiratorial “they” refers.

Sweeping Yet Vague ‘For the Children’ Proposals

As XBIZ reported, in August 2022, the California legislature passed a highly controversial bill mandating sweeping yet vague age verification measures for any website “likely to be accessed by children.”

Governor Gavin Newsom signed it into law the following month, requiring websites — including all sites containing adult content accessible in California — to determine the age of all users with what the bill calls “a reasonable level of certainty.”

The California law, which goes into effect in July 2024, further mandates that websites and platforms must overhaul privacy and safety standards based on the age verification requirement.

Both the Electronic Frontier Foundation (EFF) and tech industry trade group NetChoice have questioned the constitutionality of the bill.

The California Age-Appropriate Design Code Act was patterned after the U.K.’s “Children’s Code,” a set of regulatory standards devised by the Baroness Kidron.

Kidron funds a nonprofit called the 5Rights Foundation, which backed the California bill. One of its goals is to expand the scope of the federal Children’s Online Privacy Protection Act and change the definition of “child,” for online purposes, from anyone under 13 to anyone under 18.

Baroness Kidron is a 63-year-old former photographer, film producer and director, philanthropist and self-appointed “advocate for children’s rights in the digital world.”

Her U.K. feature films include “Vroom,” “Oranges Are Not the Only Fruit” and “Antonia and Jane.” In 1992 she moved to the U.S., where she worked with Miramax Pictures’ Weinstein. She directed “Used People,” the sex work documentary “Hookers, Hustlers, Pimps and Their Johns,” “Shades of Fear,” “To Wong Foo, Thanks for Everything! Julie Newmar” and romantic comedy sequel “Bridget Jones: The Edge of Reason,” starring Renée Zellweger, Colin Firth and Hugh Grant.

A Poshly Accented Baroness Who Want to Save Kids from ‘Big Tech’

In 2012, Queen Elizabeth made Kidron a Baroness and she was introduced in the House of Lords. She was appointed on the recommendation of the House of Lords Appointments Commission and is an unelected “life peer,” legislating in the U.K. as a member of the House of Lords Democracy and Digital Technologies Committee.

Kidron, the Politico writers gushingly wrote, “used a combination of perseverance and savvy politics to become arguably the most important and effective driver of data privacy and social media rules in the United States.”

Asked to described “how tech companies had treated children for years,” Kidron told Politico that “they boiled kids alive online.”

The writers credit Kidron’s “fancy British accent” as one of the reasons her lobbying “pays off” in the sometimes provincial, awestruck world of local U.S. politics.

Politico reveals that Kidron has been lobbying U.S. Senators Richard Blumenthal (D-Conn.) and Marsha Blackburn (R-Tenn.), who are the co-authors of the equally controversial and vague federal KOSA Act.

“I think she’s been dynamite. The age verification standards in the U.K. is a model for us,” Blumenthal told Politico. “She has enormous influence. Her advocacy has impacted our way of thinking.”

But EFF told Politico that Kidron’s self-educated advocacy creates imprecise legislation that is based more on grandstanding, pandering “save the children” emotionality rather than on technical knowledge of the intricacies of online communications.

The California law’s drafting weaknesses, an EFF rep noted, “are concerning enough that we urge other states not to use it as a starting point for their own bills.”

Jane Dro Marks Studio Debut Opposite Puerto Rock in New Thiccvision Series

LOS ANGELES — Thiccvision has debuted the first episode of its newest series, titled “1 on 1 Encounters,” featuring content creators Puerto Rock and Jane Dro, in her first studio shoot, under the direction of Junior Money from Benjamin Media Group.

A rep noted the studio is focused on “natural chemistry [and] a potent mix of passion and anticipation for its costars.”

The new tryst was co-produced by Jay Playhard of Playhard Media Group and Savanna Star of Star Power Media.

Playhard noted the chemistry between Rock and Dro was obvious. “The entire room could see it,” he added. “That’s why they were chosen to introduce this new series to the world.”

“Jane is everything you can imagine and then some,” he continued. “This scene is perhaps one of my all-time favorites because the passion is my kind of lane, so on a scale of 1-10, this was an 11.”
