LAS VEGAS — Vice News’s Cryptoland aired a report last week on “The Link Between Sex Work And Crypto.”

The half-hour report, available via Vice’s YouTube channel here, explained that “sex workers were some of the earliest adopters of Bitcoin, using crypto out of necessity when traditional banks and financial institutions cut them off,” and posed the question of whether crypto is “a solution or merely a Band-Aid.”

The first half of the report featured a visit to the Las Vegas headquarters of SpankChain, a live-work space known as “The SpankHouse.”

The Vice News reporter spoke with SpankChain co-founder and CEO Ameen Soleimani, and with company spokesperson and sex worker Allie Eve Knox.

Knox walked Vice News through an NFT photo shoot featuring herself, and spoke about her experiences with mainstream banking, which eventually led to a discussion of the blockchain space in general and SpankChain in particular.

The second part of the report repurposed part of a lengthy round table discussion on the same topic, originally broadcast in July, hosted by Vice News’ Krishna Andavolu and featuring Vice’s Motherboard tech reporter Samantha Cole and sex worker and author Liara Roux.

AUSTIN, Texas — The Fifth Circuit Court of Appeals today upheld a controversial Texas law prohibiting social media platforms from “censoring speech based on the viewpoint of its speaker,” in a decision that ignored long-standing precedent that First Amendment protections prohibit only censorship by the government, not by private companies.

According to the court’s decision, even though platforms contend that “the statute is facially unconstitutional and hence cannot be applied to anyone at any time and under any circumstances,” the majority-conservative justices on the Fifth Circuit bench “reject the idea that corporations have a freewheeling First Amendment right to censor what people say.”

“Because the district court held otherwise,” the judges declared, “we reverse its injunction and remand for further proceedings.”

The ideologically-worded decision also included the judges’ opinion that “the platforms offer a rather odd inversion of the First Amendment. That Amendment, of course, protects every person’s right to ‘the freedom of speech.’ But the platforms argue that buried somewhere in the person’s enumerated right to free speech lies a corporation’s unenumerated right to muzzle speech.”

The implications of the platforms’ argument, they continued, “are staggering. On the platforms’ view, email providers, mobile phone companies, and banks could cancel the accounts of anyone who sends an email, makes a phone call, or spends money in support of a disfavored political party, candidate, or business. What’s worse, the platforms argue that a business can acquire a dominant market position by holding itself out as open to everyone.”

A Republican Law Upheld by Conservative Judges

The Republican-backed state law, HB 20, would make social media platforms liable for moderating content based on what the law defines as “viewpoints.” It was drafted with the support of Texas governor Greg Abbott as an answer to conservative complaints about supposed “liberal bias” in platform moderation, including the lifetime Twitter ban of former President Donald Trump.

The law has been subject to a back-and-forth judicial process. As XBIZ reported, back in May, the U.S. Supreme Court temporarily blocked HB 20, shortly after a Fifth Circuit three-judge appeals panel ruled that the law could go into effect “immediately” — in turn staying a previous district court injunction that had put enforcement of the law on hold.

The Fifth Circuit panel decision in May was communicated without explanation as to the court’s reasoning and with two of the judges remaining anonymous. At the time, tech news site Protocol reported that, during the hearings, “the jurists appeared to struggle with basic tech concepts, including whether Twitter counts as a website.” 

That decision, ratified today, was seen “a win for conservative critics of the current interpretation of tech law, which underlies the operations of social media platforms such as Twitter and Facebook,” Protocol continued.

Industry Lawyer Weighs In

“It appears the Fifth Circuit got the First Amendment analysis alarmingly wrong,” said industry attorney and First Amendment expert Lawrence Walters, of the Walters Law Group. “It deems the platforms’ actions in hosting and facilitating speech to be ‘conduct,’ not speech, in disregard of decades of precedent recognizing the First Amendment rights of platforms to engage in their own speech through editorial decisions.”

Walters added that he suspects “the decision will be reversed if taken up by the Supreme Court.”

Idaho Conservatives Rally Against Porn Literacy Classes After National Panic Campaign

BOISE, Idaho — After a national moral panic campaign by right-wing blogs and social media accounts, Idaho conservatives are pressuring public officials to suspend porn literacy classes being offered as part of the state’s sex education programs.

A right-wing group called the Idaho Freedom Foundation took credit for initiating the campaign, claiming in a blog post that public health districts in the state “promote abortion, porn, gender transition and other degenerate topics” under the Idaho Department of Health and Welfare’s sex education program.

The term “degenerate,” which the group uses to designate any form of sexual content, was prominent in eugenics discourse and used extensively by the Nazi regime in the 1930s and 1940s to justify censorship.

Idaho Freedom Foundation staffer Anna Miller tweeted, “Idaho’s government offers ‘porn literacy’ to students, Planned Parenthood curriculum and advocates for abortion. If this can happen in Idaho, it can happen anywhere.”

The conservative group called for “public outrage” about Idaho’s sex education program, “funded by federal grants,” using tax dollars to “purchase sex education products from the group Education, Training, and Research (ETR), whose curriculum is developed and endorsed by Planned Parenthood” and derided ETR as “an interest group promoting porn literacy.”

The group objected to what it termed “instruction on kink and power, pleasure, sexual identity, sexual acts, and sexual exploration in relation to pornography.” The Idaho Department of Health and Welfare, by contrast, described the program as “evidence-based, optional sex education curriculum.”

Libs of TikTok Magnifies the Moral Panic at a National Level

Controversial right-wing social media account Libs of TikTok then magnified the moral panic at a national level, mocking an ETR video discussing non-shame-based sex education, teaching critical thinking skills, and the importance of porn literacy for students.

A researcher with conservative think tank The Heritage Foundation tweeted, “The future of conservatism will depend on parents willing to be called bad names in order to fight back against the people pushing porn, drag queens and gender confusion on our kids.”

The Idaho Freedom Foundation decried what it called “radical gender ideology” infiltrating Idaho schools, and quoted social media comments from “the public” declaring, “That’s why I homeschool,” “This is unbelievable and has got to stop!” “What ever happened to just sticking with teaching the three R’s in elementary schools?” and “It’s things like this that remind people why they need school choice.” 

The group also quoted Allie Stuckey, an American Conservative commentator and podcast host, claiming that “Teaching children ‘porn literacy’ in school is sexual abuse.”

The Idaho Freedom Foundation called upon the Idaho Legislature to “put a stop to both Planned Parenthood and ETR’s influence in schools by rejecting federal grants funding the state’s sex education program.”

The Idaho Department of Health and Welfare Responds

The Idaho Department of Health and Welfare (DHW) issued a statement yesterday, Big Country News reported, clarifying that its Reducing the Risk program for Idaho schools “does not discuss porn literacy, and it is not a subject taught in the curriculum DHW provides. DHW does not collaborate with or seek the endorsement of Planned Parenthood for sex education curriculum.”

DHW further stressed that “high schools or school districts can choose to offer Reducing the Risk as part of a sex education curriculum. Schools that choose to offer Reducing the Risk do so with parental consent. They offer opt-in or opt-out for parents, in accordance with school district policies and Idaho Code.”

Groups like the Idaho Freedom Foundation do not oppose all mentions of porn in educational contexts, however, as school districts throughout the country regularly invite religious and conservative anti-porn and anti-sex-work speakers to disseminate non-fact-based “porn education.”

LOS ANGELS — Free Speech Coalition has joined civil rights and sex worker rights groups in filing “friend of the court” amicus briefs defending Twitter, Craigslist and Omegle against FOSTA-enabled civil litigation alleging they profited from sex trafficking. 

FSC Executive Director Alison Boden said, “Since the passage of FOSTA in 2018, we’ve seen numerous litigants sue platforms for the actions of independent users on those platforms. We are concerned that the courts are not giving proper weight to the protections of First Amendment and Section 230, nor the limitations of the FOSTA exemption.”

Boden thanked the ACLU for inviting FSC to join the briefs, and said her organization was “proud to stand alongside them in defense of our constitutional rights.”

Amicus briefs are a critical method for advocacy organizations like FSC and other interested parties to contribute to the legal analysis in pending litigation, providing insight, experience and knowledge that may not be otherwise apparent to the court. In addition to joining with other organizations on amicus briefs, FSC has filed its own amici in cases related more directly to the adult industry, in addition to  successfully defending the rights of the industry at the US Supreme Court in Ashcroft v. Free Speech Coalition.

“FSC has specialized knowledge of the history of sexual speech and its direct implications for free expression that other 1st Amendment advocates may not,” said Boden. “We have also taken on fights that others would not, and successfully defended the rights of our industry. This is a history that these amicus briefs build on, and we look forward to growing our legal advocacy work and alliances in the coming year.”
