FSC Asks Supreme Court to Overturn 5th Circuit Decision, Strike Texas’ Age Verification Law

WASHINGTON — Free Speech Coalition (FSC) filed a petition for certiorari on Friday asking the U.S. Supreme Court to overturn the Fifth Circuit panel decision that partially upheld Texas’ controversial age verification law.

Represented by the American Civil Liberties Union and the law firm Quinn Emanuel Urquhart & Sullivan, the Free Speech Coalition and others today asked the U.S. Supreme Court to overturn a lower court ruling that, if left standing, would improperly burden free speech online. The petition for certiorari was filed in Free Speech Coalition v. Paxton, which challenges an unconstitutional age-verification provision in Texas’s H.B. 1181.

“Though it purportedly seeks to limit minors’ access to online sexual content, the law in fact imposes significant burdens on adults’ access to constitutionally-protected expression, requiring them to provide personal identifying information online to access sensitive, intimate content” said Vera Eidelman, staff attorney with the ACLU Speech, Privacy and Technology Project. “This isn’t the first time that concerns about minors’ access have led legislators to pass unconstitutional laws. We’ve gone through this time and again, with everything from drive-in movies to video games to websites, and courts have repeatedly struck down laws imposing requirements that burden adults’ access to non-obscene sexual content in the name of protecting children.”

HB 1181 requires certain sites with sexual content to force their visitors to provide digital IDs or other proof of age before they can access the published material. Sites that do not comply could face up to $3 million in fines. This provision claims to protect minors from accessing sexual content deemed harmful to them, but it does not merely restrict minors’ access. It also restricts adults’ access to this content, effectively requiring them to identify themselves online. Requiring individuals to verify their ages before accessing this protected speech robs people of anonymity, and threatens to bar individuals—for example, those who lack government identification or whose age is mis-identified by the relevant technology—from accessing certain websites altogether. The ACLU and its partners argue that the law places an impermissible burden on the exercise of adults’ First Amendment rights online.

“Despite proponent’s claims, age-verification online is simply not the same as flashing an ID at a check-out counter. The process is invasive and burdensome, with significant privacy risks for adult consumers,” said Alison Boden, executive director of the Free Speech Coalition. “In states where these laws have passed, the vast majority of users have refused to comply, leading to a massive chilling effect on their legal right to access constitutionally protected speech. Adult sites are the canary in the coal mine of free speech, and we look forward to defending the rights of all Americans to access the internet free from surveillance.”

Before the case reached the Supreme Court, a district court briefly blocked the law from being enforced, stating that, as written, the law’s age-verification provision would unconstitutionally chill the speech of adults. However, a divided Fifth Circuit panel recently vacated that injunction, reasoning that the age-verification provisions’ burden on adults’ First Amendment rights merely has to have some rational basis–not face strict scrutiny–because the aim is to protect children.  Unless the Supreme Court intervenes, this decision will effectively reverse decades of precedent protecting the free speech rights of adults.

In prior cases brought by the ACLU, the Supreme Court has repeatedly recognized the crucial role anonymity can play online and held that requiring users to verify their age to access protected content is unconstitutional where there are less restrictive alternatives available, like filtering software. In Reno v. ACLU, the Supreme Court unanimously ruled that anti-indecency provisions of the 1996 Communications Decency Act, also meant to protect children, violated the First Amendment’s guarantee of freedom of speech in part because of the burden it imposed on adults. In Ashcroft v. ACLU, the Court held that a law almost identical to the Texas law had to satisfy strict scrutiny because it restricted adults’ access to protected sexual speech.  Where a less-restrictive alternative exists—for example, the installation of filtering software on minors’ devices, which states can encourage or legislate—the government cannot impose age verification on adults in the name of protecting children.

Free Speech Coalition v. Paxton is one of several cases in which the ACLU has urged courts to reject age-verification schemes that would burden the free speech rights of Internet users as part of the organization’s long tradition of defending online free expression. This petition was filed jointly by the ACLU and the law firm Quinn Emanuel Urquhart & Sullivan on behalf of Free Speech Coalition, Inc., et al.

Only 27 of those countries have mandatory sex education programs. The study collected data on education levels, STDs, teenage pregnancy, and abortion rates for each of those countries, and produced a composite score.

Following Poland, the list also includes Austria, Cyprus, Malta, Germany, Switzerland, Finland, Japan, Denmark and Iceland.

The quality of sex education in Poland, a rep explained, “contributes to having one of the lowest STD rates and second-lowest abortion rates on the list, highlighting the success of comprehensive sex education there.”

SAN DIEGO — Further details have emerged in the past week about the capture and arrest of GirlsDoPorn owner Michael Pratt in Spain in December 2022, following his extradition to the U.S. last month.

As XBIZ reported, Pratt made his first appearance in federal court on March 19.

Pratt was captured in Madrid in 2022 after having been a fugitive since leaving the U.S. in 2019, and on the FBI’s “Ten Most Wanted” list since 2021.

His capture was requested by U.S. authorities through an Interpol Red Notice in a 19-count indictment for “sex trafficking, production of child pornography, sex trafficking of a minor, and conspiracy to launder monetary instruments in connection with the operation of the GirlsDoPorn adult website.”

At the time of his court appearance, FBI San Diego Special Agent in Charge Stacey Moy said that Pratt’s arrest and extradition reflected “a great collaboration among multiple agencies, both in the United States and Spain who were dedicated to seeking justice for the young women he allegedly victimized. This large, internationally coordinated effort could not have been successful without support from our law enforcement partners in Spain, the U.S. Marshals Service, U.S. Department of Justice, and Immigration and Customs Enforcement.”

An article about the extradition, published last week by the Los Angeles Times, included an interview with Brian Holm, the attorney for Pratt’s alleged victims.

According to the Times, Holm said a team of “amateur sleuths” helped authorities trace Pratt to a Barcelona mailing address.

“We got tired of waiting for him to be found,” Holm told the paper.

But sources familiar with the case and Pratt’s capture contradicted the Times report, calling it unlikely that Holm referred to “amateur sleuths,” which would discredit the FBI’s version of events.

The same sources pointed XBIZ to the description of Pratt’s capture published by Spanish newspaper El Español in December 2022, in an article that has not been quoted in English-language coverage until now.

Teamwork by Private Investigators and U.S., Spain Law Enforcement

El Español reported that Pratt was tracked by the Group of Fugitive Location of the Spanish National Police, which found him registered at a hotel on Madrid’s central Gran Vía under one of several fake identities he used during his years on the lam.

“Agents detected Pratt was to arrive at the hotel in the morning, using one of three usual fake identities. The arrest happened early in the afternoon. Intelligence officers with the police worked for more than a year trying to track him, and he was one of the outfit’s top targets.”

El Español noted that Pratt’s arrest was the first ever for someone on the FBI’s notorious Ten Most Wanted list, which in the past has included extremely high-profile criminals such as Osama Bin Laden.

Once the Spanish authorities received the information from their U.S. counterparts, they initially tracked Pratt to a Barcelona address — but due to several complications, an arrest could not be made at the time, the newspaper reported.

At that point, several U.S. private investigators traveled to Spain and teamed up with American and Spanish law enforcement agents to follow Pratt’s trail from Barcelona to Madrid, resulting in the December 2022 arrest.

It is most likely that Holm was referring to these private investigators when speaking with the Times, which then incorrectly relabeled them as “amateur sleuths.”

As of Thursday afternoon, six days after publication, the Times had not issued a correction.

Pratt entered a “not guilty” plea before U.S. Magistrate Judge Daniel E. Butcher. A motion hearing/trial setting has been scheduled for April 19.

LOS ANGELES — Performer and creator Robby Echo has formally announced that he will be using the name “Robby Apples” going forward.

“I’ve been in the industry for 10 years now and so many people know me as the ‘Apple Man,’” Apples told XBIZ. “So I decided 2024 was the year to flip this turkey. There was a time I thought about saving ‘Apples’ for mainstream stuff and ‘Echo’ for porn, but it just seemed like too many names. I’m just one man!”

The XBIZ Award nominee credits colleagues Alison Rey and Kasey Warner for coming up with the pomme-rific moniker.

“Those rascals made a fake Twitter account years ago called ‘Robby Apples’ where they would post photos of me eating apples,” he explained.

The Robby Apples rebrand is also more in tune with his often zany public persona — he and fellow “Valley boy” Shawn Alff are notorious at industry events for skimpy coordinated outfits and psychedelic shenanigans — and with his personal commitment to a natural lifestyle.

“I’ve been a health-oriented person since my early 20s,” Apples said. “I had an ailment that forced me early on to make the connection between eating healthy and feeling better and happier. So when I started shooting porn, I knew immediately I was going to need some apples to get all this fucking done. Fucking requires a lot of energy and apples are a great complex carb, which means they will give you longer sustained energy than a simple carb. In my book, every carb should be complex just like the beautifully complex beings that we are.”

The quintessential fruits, Apples concluded, are “just like us.”

“Their mothers eat from the earth to create them and then we eat them, poop them back into the earth so that other apple mothers can continue eating from the earth to create more apples. We’re essentially the same. Remember, everyone: We are all in this together. The more healthy and happy you are, the more healthy-happy people we have to hang with.”
