Rachael Cavalli to Headline New York’s Sapphire 39

HOLLYWOOD, Calif. — Rachael Cavalli will headline a one-night-only performance at the Sapphire 39 gentlemen’s club tomorrow.
 
In addition to dancing, Cavalli will offer a meet and greet and give them a chance to take a selfie. Consumers will also be able to buy her merch and purchase a lap dance.
 
“I’m excited to be back at Sapphire — it’s one of my favorite gentlemen’s clubs, and I really love New York. If you’re in the city or planning to be here, you don’t want to miss my feature at Sapphire 39,” Cavalli said.

Florida Seeking to Redefine Sex Censorship Language

TALLAHASSEE, Fla. — The Republican-run state government of Florida is stepping up efforts to redefine legal and policy terminology in a campaign to censor free speech concerning sexuality.

The latest incident involves Florida’s Department of Management Services, which has issued a document limiting protests in the Florida Capitol, in the name of “protecting the children.”

The revised statement now reads, “Because the Capitol Complex is often a destination for children learning about their State government, visual displays, sounds, and other actions that are harmful to minors … or which include gratuitous violence or gore are not permitted in any portion of the Capitol Complex that is not a traditional public forum.”

“The phrase ‘harmful to minors’ now stands in place of the previous wording ‘materials that arouses prurient interests,’ which was criticized by activists for being vague,” the Florida Phoenix reported yesterday.

The language “harmful to minors,” the report continued, “refers to Florida Statutes that outline definitions of topics such as ‘sexually oriented materials’ and ‘nudity,’ among other terms. The previous rule prohibited visual displays, sounds, and other actions ‘that are indecent,’ but that phrasing has been struck out in the new rule.”

Although the new phrasing may have been instituted in response to a recent protest during which high school students reportedly marched through the Capitol shouting “Fuck DeSantis,” equating all sexual expression with “gratuitous violence and gore” is consistent with current conservative attempts to shift the language of censorship from vague, old-fashioned terms like “prurient” and towards dubious claims of harmfulness to children.

In October, for example, Missouri Secretary of State Jay Ashcroft proposed a ban on funding for library books “that appeal to the prurient interest of any minor.”

The term “prurient” bears a very specific legal meaning, which Ashcroft’s ban would redefine. Appeal to prurient interest is central to the Miller test, developed in the 1973 case Miller v. California, which is used by courts all the way up to the United States Supreme Court for determining whether speech or expression can be labeled “obscene” and therefore not protected under the First Amendment.

Utah Rep. Ken Ivory (R-West Jordan) has gone even further, recently dismissing the Miller test, which has been the nation’s legal standard for a half century, as merely the opinion of a few Supreme Court justices at the time, and demanding a total reversal of the last 50 years of legal and judicial practice. 

Penny Barber Makes Deeper Debut

The scene features Manuel Ferrara and is directed by Kayden Kross. The action opens with Barber reading a newspaper and in 1950s clothing. She sees Ferrara doing laundry. When the last patron leaves the laundromat, she takes off her coat to reveal she is wearing lingerie. Ferrara takes the hint and the two get physical with one another.
 
“I’m so glad the scene is finally out. My fans keep asking me and today is the day. I really enjoyed working with Kayden and Manuel. The script of a silent seduction playing out in plain sight in a retro laundromat was really hot,” Barber said. “The scene looks incredible, and I had a great time filming it.”

Braun scored four of the noms, for “Best Screenplay,” “Best Art Direction,” “Best Editing” (with Claudia Ross), and “Best Cinematography” (with James Avalon and Ralph Parfait).

Acting nominations went to Seth Gamble for “Best Lead Acting” and Kenzie Taylor for “Best Supporting Acting.”

Finally, Gamble and Kenna James were nominated for “Best Feature Movie Sex Scene.”

Braun shared his enthusiasm about the title.

“‘Spideypool XXX’ is my 62nd parody, and definitely my favorite one,” he said. “It’s a movie that really serves as a perfect example of what a porn parody should be: funny, sexy, full of easter eggs and extremely respectful of the source material. LA Direct’s Derek Hay Indicted in Pandering Probe

LOS ANGELES — A recently unveiled Grand Jury document revealed this week that LA Direct agent Derek Hay has been indicted as part of a criminal case for “conspiracy to commit pandering” and “conspiracy to commit pimping.”

The Grand Jury indictment document was filed on September 28, but was only made available this week.

The indictment names Hay alongside two co-defendants. The three are accused by the State of California of “conspiracy to commit pandering by procuring” in violation of Penal Code 266i (a), a felony, and “conspiracy to commit pimping” in violation of Penal Code 266h (a).

The felony of pandering — punishable by imprisonment in state prison for three, four, or six years — is defined as any of the following: “(1) procuring another person for the purpose of prostitution; (2) by promises, threats, violence, or by any device or scheme, causing, inducing, persuading, or encouraging another person to become a prostitute; (3) procuring for another person a place as an inmate in a house of prostitution or as an inmate of any place in which prostitution is encouraged or allowed within this state; (4) by promises, threats, violence, or by any device or scheme, causing, inducing, persuading, or encouraging an inmate of a house of prostitution, or any other place in which prostitution is encouraged or allowed, to remain therein as an inmate; (5) by fraud or artifice, or by duress of person or goods, or by abuse of any position of confidence or authority, procuring another person for the purpose of prostitution, or to enter any place in which prostitution is encouraged or allowed within this state, or to come into this state or leave this state for the purpose of prostitution; (6) receiving or giving, or agreeing to receive or give, any money or thing of value for procuring, or attempting to procure, another person for the purpose of prostitution, or to come into this state or leave this state for the purpose of prostitution.”

The felony of pimping is described by the statute as concerning “any person who, knowing another person is a prostitute, lives or derives support or maintenance in whole or in part from the earnings or proceeds of the person’s prostitution, or from money loaned or advanced to or charged against that person by any keeper or manager or inmate of a house or other place where prostitution is practiced or allowed, or who solicits or receives compensation for soliciting for the person, is guilty of pimping, a felony, and shall be punishable by imprisonment in the state prison for three, four, or six years.”

The victims of the alleged pandering and pimping are only identified as “Jane Does” and “Individuals.”

The Accusations Against Hay

Although most of the charges concern the other two co-defendants, Hay is accused of sending a message to one of the co-defendants asking them to “cease all bookings” of someone only identified as Individual 1, of introducing Jane Doe 2 to the co-defendants during a dinner, of sending text messages to Jane Doe 4 concerning introducing her to one of the co-defendants, of text messaging Jane Doe 4 about sending her photos to one of the co-defendants, and of communicating with Jane Doe 4 concerning “a private job.”  

Among the accusations against the other co-defendants, those involving Hay include: “inducing” Jane Doe 1 to be represented by Hay, telling Jane Doe 1 that they “intended to pay a referral fee for Jane Doe 3” to Hay, contacting Jane Doe 1 to discuss a letter sent by attorney Allan Gelbard to Hay, and communicating with Hay regarding someone identified as Individual 4.

As XBIZ reported, Hay first faced criminal pandering charges in California in early March 2020, stemming from accusations made during the “Jane Does” labor case. That case involved five of his former models petitioning against him and his agency before the California Labor Commission.

The March 2020 felony complaint against Hay, filed on Tuesday by the California attorney general’s office, included a warrant for “arrest and extradition” of Hay, who is based in Las Vegas.

“The charges go back 18 months or more and came from statements made by two or more of the five women who are suing him civilly with the Department of Labor,” Hay’s attorney, Richard D. Freeman, told XBIZ at the time. “This is not new information, this is not recent information. While no one wants to be the subject of a criminal investigation or a criminal prosecution, Derek is ready, willing and able to come to California to answer the charges against him and he’s confident we will disprove the charges.”

The 2020 felony charges and the September 2022 grand jury indictment are connected to the 2018 civil filings and also to testimony given by the five “Jane Does” models and former LA Direct clients — later self-identified as Charlotte Cross, Shay Evans, Sofi Ryan, Andi Rye and Hadley Viscara — during the Labor Board hearings in the fall and winter of 2019.

Viscara appears to be identified as “Jane Doe 4” in one of the unredacted text messages quoted in the Grand Jury indictment.

Both Viscara and Ryan have accused Hay of sexual assault during the Labor Board hearings. Hay and his attorney have disputed the veracity of their accounts.

XBIZ contacted Hay’s attorney today but received no comment.

Seth Gamble Racks Up 27 Nominations From 2023 XBIZ Awards

HOLLYWOOD, Calif. — Director/writer/performer Seth Gamble earned 27 nominations from the 2023 XBIZ Awards, including “Male Performer of the Year.”

His debut feature as a filmmaker, Wicked Pictures’ “Deranged,” picked up six nominations, including “Feature Movie of the Year,” personal nominations for “Feature Director of the Year” and “Best Screenplay,” and nods for “Best Art Direction,” “Best Editing” for Claudia Ross, and “Best Feature Movie Sex Scene” for Lily Larimar, Jane Wilde, and Mick Blue.

“I’m very, very thankful to see my narrative directorial debut honored with six XBIZ nominations,” Gamble said. “I’m very grateful to see the hard work we all put into it recognized. I want to thank my wonderful wife Kenzie Taylor for her inspiring work ethic and her tireless pursuit of beauty and excellence. In the acting categories, he picked up one “Best Lead Acting” nom for “Spideypool XXX: An Axel Braun Parody” (Wicked Pictures), and three “Best Supporting Acting” nods for “Drift” (Deeper), “Going Up” (Lust Cinema), and “Stars” (Adult Time), respectively. 

Six features in which he performed, including all four that garnered him acting noms, as well as “Dark Is The Night” (Wicked Noir) and “Hysteria” (Wicked Pictures), received nominations for “Feature Movie of the Year.”

Gamble received nominations for 15 scenes, including five for “Best Feature Movie Sex Scene,” three for “Best Featurette Sex Scene,” three for “Best Career-First Performance Sex Scene,” three for “Best All-Sex Sex Scene,” and one for “Best Gonzo Sex Scene.”
