Australian Court Upholds Local Censorship Powers of eSafety Commissioner Inman Grant

SYDNEY — The ongoing fight between Australia’s unelected top online censor, eSafety Commissioner Julie Inman Grant, and X owner Elon Musk over her office’s power to ban specific content in the country and also abroad, has moved into murky territory with both sides claiming partial victories.

Earlier this month, Inman Grant dropped her case in Federal Court to force X Corp. to completely remove from its platform a user-posted video depicting the assassination of an Assyrian Orthodox bishop in a Sydney church on April 15 during a church service being streamed online.

However, the eSafety Commissioner stressed she intended to continue her legal action in the Administrative Appeals Tribunal, where X started a parallel challenge against her authority. Inman Grant also said her commission “had another five legal cases against X, including over the platform’s failure to reveal how it was combating child sexual abuse material,” Associated Press reported.

Musk celebrated eSafety’s dropping of the Federal case by posting, “Freedom of speech is worth fighting for.”

But the case also served to confirm Inman Grant’s censorship powers within Australia, as judges ruled that X’s decision to not remove the video from the platform internationally, but to agree to geoblock it for Australia, was adequate.

The compromise is consistent with Musk’s non-absolutist approach to free speech. The entrepreneur has stated that X would “respect the speech laws of each country” so that the platform he purchased in October 2022 will not become “a free-for-all hellscape.”

As XBIZ reported, Inman Grant has in the past been questioned by progressive free speech advocates in Australia over her campaigns to target adult content. More recently, conservatives and libertarians have begun raising concerns about the powers granted to the country’s top censor — an unelected former tech exec born in the U.S. — with some calling for her ouster.

Musk — a powerful voice among conservatives worldwide — publicly unleashed his criticism of Inman Grant as soon as her office challenged the geoblock approach and demanded the complete removal of the video.

“Our concern is that if ANY country is allowed to censor content for ALL countries, which is what the Australian ‘eSafety Commissar’ is demanding, then what is to stop any country from controlling the entire Internet?” he posted about Inman Grant, who before entering public service had once worked for Twitter, before Musk’s purchase.

Three weeks before Inman Grant dropped the federal case in early June, Justice Geoffrey Kennett had withdrawn an injunction requiring X to hide the content globally, AP reported.

Kennett agreed with X’s argument that the global ban was not “reasonable,” and stated that it “clashed with an international concept of the ‘comity of nations,’ which recognizes that countries’ laws have territorial limits.”

“If given the reach contended for by the commissioner, the removal order would govern the activities of a foreign corporation in the United States and every country where its servers are located,” Kennett wrote. “It would be a clear case of a national law purporting to apply to persons or matters over which, according to the comity of nations, the jurisdiction properly belongs to some other sovereign or state.”

However, Kennett upheld the geoblock compromise, which effectively buttressed Inman Grant’s controversial powers to censor content within Australia.

A recent article by an Australian libertarian think tank quoted Inman Grant’s statements at the World Economic Forum’s annual gathering in 2022, where she advocated for “a recalibration of a whole range of human rights that are playing out online, from freedom of speech to the freedom to be free from online violence.”

As XBIZ reported, the vocally anti-porn Inman Grant has acknowledged having conversations with U.S.-based, religiously-inspired lobby NCOSE — formerly Morality in Media — and even appeared on an NCOSE podcast at the Coalition to End Sexual Exploitation summit in July 2021, shortly after the Australian Parliament passed the Online Safety Act.

In November 2021, Australian progressive investigative outlet Crikey published a lengthy report on Inman Grant’s obsession with banning online porn.

Wicked Drops 3rd Installment of Seth Gamble’s Erotic Thriller ‘Iris’

LOS ANGELES — Wicked Pictures has released the third installment of reigning XBIZ Performer of the Year Seth Gamble’s latest feature, “Iris.”

The erotic thriller stars Blake Blossom in the title role, along with Emma Hix, Jennifer White, Charles Dera, Dan Damage and Alex Mack.

The third scene, titled “Decision,” features Blossom, Hix and Mack.

Gamble also enthused about his cast.

“As the director, I was incredibly impressed by the preparation each of them brought to the table,” he said. “Blake approached the scene with a methodical precision, immersing herself in the character’s imagined backstory and motivations. She memorized lines not just for accuracy, but to internalize every nuance and inflection, ensuring her performance was emotionally charged. Emma came from a more organic place; her ability to convey subtle shifts in emotion through body language and facial expressions added layers of depth to the scene, turning the screws on the tension we wanted to create. Alex, meanwhile, was very natural, and really delivered with his understanding of pace and timing – a lot of what he needed to do involved reacting to the head games at play between the two women. He brought a natural intensity to his character that made the scene feel real and immediate.”

NCOSE CEO Repeats Factually Inaccurate Statements About Pornhub Moderation at Ted Cruz Event

WASHINGTON — NCOSE CEO Dawn Hawkins repeated factually inaccurate claims about Pornhub’s content moderation on Tuesday during a press conference co-organized in Capitol Hill by Republican Sen. Ted Cruz.

The event was the public unveiling of Cruz’s Take It Down Act, co-sponsored by Democratic Sen. Amy Klobuchar. The proposed bill criminalizes the act of uploading image-based sexual abuse and mandates its removal within 48 hours.

Hawkins was invited to represent NCOSE alongside members of other organizations which support the bill like RAINN and the National Center for Missing and Exploited Children (NCMEC).

In 2015, Hawkins — a pro-censorship Mormon activist with a background in conservative and GOP PR — was instrumental in rebranding Morality in Media as “National Center on Sexual Exploitation” (NCOSE) in order to secularwash its historically religious motivation and align the group’s optics to imply alignment with the more prestigious, secular NCMEC. 

Hawkins used the occasion to mischaracterize Pornhub’s current moderation practices.

“Platforms like Pornhub, Reddit, and X let anyone upload sexually explicit content of anyone at anytime, and then they not only drive people to the content through ads — they also enable countless downloads and reshares,” Hawkins stated, standing in front of a pensive Sen. Cruz. “This is the unacceptable reality we face today, and it will remain so unless Congress acts now.”

Hawkins later shared a video of her non-factual remarks on NCOSE’s X account.

A Pornhub rep told XBIZ, “Obviously, the claims in the video are not factually accurate, at least as it relates to our platforms.”

The rep shared Pornhub and parent company Aylo’s trust and safety processes, which he noted “directly contradict many of the claims in the video.”

Pornhub considers its current, comprehensive safeguards are unprecedented in user-generated platform history in terms of tools to prevent and eliminate unwanted material. 

Despite Hawkins’ baseless remarks in front of the legislators who invited her, Pornhub’s safeguards include an uploader verification program that uses secure biometric facial recognition technology to ensure the identity of the uploader of all pieces of content; co-performer verification, which establishes consent from all participants in uploaded content; an inability to download free content; continuous additions to its suite of automated moderation tools (CSAI Match, Content Safety API, PhotoDNA, Vobile, Safer, Safeguard, NCMEC Take It Down, StopNCII); utilization of digital fingerprinting technology to prevent the re-upload of unauthorized material, a Content Removal Request Form which, upon being completed by any user, is to immediately and automatically disable a piece of content pending further review; partnerships with leading global internet safety non-profit organizations; among other safeguards.

“Aylo’s safety and security measures have set a standard for compliance programs in the tech and social media industries, and credible third-party analyses have commended the success of our efforts to date,” the rep said. “For example, NCMEC reported that Aylo platforms reported fewer incidents of CSAM, and removed material NCMEC flagged quicker upon being notified, than other major tech platforms including Facebook, X, Google, Instagram, and more. We are proud to be at the forefront of content moderation on the internet, and we are committed to continually evolving our Trust and Safety practices to remain leaders in internet safety.”

As XBIZ reported, lawmakers from both major political parties continue inviting Hawkins and secularwashing NCOSE in spite of the organization’s documented past of homophobic activism, and current crusades to criminalize all forms of sex work and eradicate all adult content.

Democratic New York Rep. Alexandria Ocasio-Cortez issued a press statement in March prominently highlighting her partnership with NCOSE, during her introduction of the Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024 (DEFIANCE Act), which proposes to create a federal civil right of action for victims of deepfakes.

After XBIZ reported on the collaboration between AOC and NCOSE, her chief of staff, Mike Casca, called the story “bullshit.”

“It’s not a partnership,” Casca told XBIZ through his X account. “She has a bipartisan bill to stop nonconsensual deepfake pornography that centers survivors’ civil right of action. Orgs left, right and center support it. Bipartisanship is how bills become law in a divided congress.”

Casca declined to answer any follow-up questions specifically about NCOSE, particularly as to how the foregrounding of the pro-censorship lobby — it was listed second in a nonalphabetical list of more than 30 endorsing organizations and Hawkins’ quote is one of only two offered by any of those groups — constituted “bipartisanship.” 

Although the stentoriously conservative Sen. Cruz may appear to be a more suitable ideological bedfellow for NCOSE and Hawkins, his official X account has a notoriously documented history of enjoying explicit, unpaid pornography — specifically, Cory Chase’s work for Reality Kings — on its feed.
