MONTREAL — MindGeek has responded to the massive civil lawsuit filed yesterday by a group of attorneys, headed by a former lawyer for Donald Trump and Jerry Falwell Jr. on behalf of women whose videos were uploaded onto Pornhub by third parties, by reiterating their commitment to “eradicating illegal content” and by having implemented earlier this year “the most comprehensive safeguards in user-generated platform history.” 

MindGeek responded to the lawsuit yesterday through a statement to CBS News, who published a fully reported piece on the very same morning that Michael J. Bowe and the other attorneys for 34 plaintiffs filed it.

MindGeek called the lawyers’ allegations that it is not a business but a criminal enterprise — which repeatedly refer to fictional pop culture movies about the mafia stating that the adult business is “like the Sopranos” and calling its executives and investors “the bosses” — “utterly absurd, completely reckless and categorically false.”

MindGeek told CBS that the company has “banned uploads from unverified users, eliminated downloads, expanded our moderation processes and partnered with dozens of nonprofit organizations around the world, steps that surpass those of any other major platform on the internet.”

Bowe: The Porn Industry was ‘a red light district’

The CBS News report, which includes both video and print versions featuring extensive interviews, appears to have been prepared with insider knowledge of the lawsuit’s content and allegations. It prominently features accounts of women reporting that videos were made when they were minors or unable to consent and then uploaded online by third parties, with Bowe trying to argue the women are thereby victims of “sex trafficking” by Pornhub.

Section 230 shields companies from most liability for third-party content uploaded to their platforms, but the “trafficking” language suggests Bowe may be trying to invoke the FOSTA/SESTA exception to the so-called “first amendment of the internet.”

CBS News also says Bowe insists that “his goal isn’t to ban online pornography, but rather, to force it to comply with regulations.”

“This case is not about porn, it’s about rape,” he said “This is a legitimate industry that consenting people have every right to participate in. It just needs to be done legally and not with illegal content.”

Bowe explicitly said that he considers the “traditional porn industry” to have been a “red light district” (i.e., segregated from “non-porn”) before the advent of tube sites, and that he wants to take it back to that situation.

Bowe has not explained how he intends to segregate this virtual “red light district” from the rest of the internet or, more crucially, who would make the decision of which content is considered “pornographic” and thus blocked-off into this imaginary, virtual “wrong side of the tracks.”

A (Rare) Accurate Mainstream Characterization of Mickelwait and Exodus Cry

Unlike the sensationalistic New York Times article by Nicholas Kristof that began the current onslaught against MindGeek and Pornhub, and the several pieces that followed in the mainstream media that echoed its lack of contextualization about the religiously motivated War on Porn, CBS News actually included this important factual information.

“Some of the victims in the lawsuit told CBS News they joined after they discovered their non-consensual videos on Pornhub and reached out to an activist named Laila Mickelwait,” the report states, correctly characterizing her. “In 2020, Mickelwait founded a campaign called Traffickinghub which started a petition to ‘Shut Down Pornhub.”

Traffickinghub, CBS News continued, says it’s “powered by” a religious organization called Exodus Cry, which has been criticized for its efforts to criminalize parts the sex industry and abolish pornography altogether. On its website, Exodus Cry advocates for laws to ‘end the sex industry’ and ‘reduce the demand for commercial sex.’”

This is relevant information given that Mickelwait has vocally hailed Bowe’s activities, and that activist journalists like Kristof in the U.S. and Alexi Mostrous in the U.K. all participate in a Twitter echo chamber saluting each other for their anti-Pornhub efforts.

Lawyer Calls for ‘Oversight’ of Porn Industry

But Bowe still claims that “this is not about pornography” and claims MindGeek “skirted rules that have long been in place to protect actors in the ‘traditional’ porn industry, which requires producers to verify the age and identities of the people featured in videos.”

“The online porn industry has essentially been the ‘red light district’ of commerce,” Bowe said. “This new industry of online porn, for the last 10 years, has been allowed by law enforcement, government entities, to operate by a different set of rules. Basically, no rules or oversight.”

Bowe apparently did not explain to CBS News what he means by “oversight,” or whether the government or the state should be in charge of it, or which branch of the government or state, for that matter. He has also not stated who would be in charge of deciding how to separate “this new industry of online porn” from any other kind of online business.

Dink Flamingo Returns to Active Duty as Director, Producer

LOS ANGELES — Notable producer-director Dink Flamingo has returned to Active Duty, the military fetish brand he founded more than 20 years ago.

His first new “recruit,” sandy-haired hunk Sebastian Woods, was introduced last month and will make his hardcore debut July 11 paired with fan-favorite performer Jaxon, who last appeared onscreen for the company in 2015.

Flamingo founded Active Duty in 1998 and ran it until 2014, when he sold the company to Gamma Entertainment; four years later, he returned to producing and directing with AmateurStraightGuys.com, a property he’d purchased in 2010.

Active Duty itself received a brand revamp last year; the company is run by Next Door Studios and is part of the BuddyProfits network.

“Lately I started reminiscing about my days at Active Duty and I wanted to get back in the action and behind the camera,” Dink recalled. “I reached out to the crew at Active Duty and offered to share some of my most recent recruits. It’s been great filming again and I know Active Duty fans will be excited with the guys I’ll be introducing in the coming months.”

“My mission when I started Active Duty was to create a safe place where real military men could explore their sexual fantasies without the reality of the hyper-masculine constraints of their daily life while simultaneously turning what was once only fantasy for those who loved, admired and lusted after them into reality,” the director explained. “Looking back, I really feel I accomplished that mission. New Doc ‘Who’s Your Teacher?’ Examines Role of Adult in Sex-Ed

LOS ANGELES — Nickey Huntsman, Ela Darling, Lotus Lain and Nina Hartley are among the performers who appear in “Who’s Your Teacher?” a new documentary by former educator Ani Easton Baker and published by actor and filmmaker Anna Akana on her YouTube channel. The doc explores how the public has come to rely on adult entertainment and its performers to learn about sex and sexuality.

Through her research, Baker saw that large number of people have turned to porn to find answers to basic questions about sexual health and wellness; due to a “profound lack of information across the nation,” Baker explained, “young people are educating themselves about sex by Googling.”

Of note, she observed the United States has no national policy mandating that students are educated about sex. As research from Planned Parenthood highlights, “Only 29 states and the District of Columbia have laws that mandate sex education, and even in those states there’s no guarantee that the sex education provided is of high quality, or covers the topics young people need to learn about to stay healthy. Fewer than half of high schools and only a fifth of middle schools are teaching the sexual health topics that the Centers for Disease Control and Prevention (CDC) considers ‘essential’ for healthy young people.”

Further, only nine states require sex educators to discuss “LGBTQ identities and relationships.” Multiple states prohibit the teaching of LGBTQ topics thereby leaving students “without the information they need to protect their sexual health, putting them at greater risk for STDs, pregnancy, and unhealthy or abusive relationships.”

Being that pornography is a top search result when using Google and other search engines to answer questions about sex, “adult film stars are becoming educators whether they choose to or not,” Baker said.

She cited academic research confirming this behavior. For example, a 2015 article titled “The Role of Sexually Explicit Material (SEM) in the Sexual Development of Black Young Same-Sex-Attracted Men” and published in the journal, “Archives of Sexual Behavior,” found that Black LGBTQ teens turned to pornography to learn about sex because there was an absence of sex education in their community.

Though the role of sex educator was forced onto them, many adult performers have stepped up to fill the role.

Besides Huntsman, Darling, Lain and Hartley, Chad Alva and Nathan Bronson are also among the performers Baker interviewed for her film.

“Porn is fantasy for adults. We don’t look at any other form of fantasy media, whether it’s action movies or horror movies… to teach us life skills. We don’t ask ‘The Fast and The Furious’ to teach kids driver’s ed,” Darling said. “But somehow with porn, we expect it to be instructional. And that’s not the point of most porn.”

Despite the frustration of being thrust into the role of educator, the performers clearly empathized with the individuals asking questions about sex.

Huntsman, for instance, explained that she endeavors to answer questions with straightforward answers. However, she said, “a lot of people don’t understand because those [subjects] don’t get discussed,” noting they lack the crucial context to be able to apply her answers to their own lives.

Additionally, while Lain didn’t initially understand why adults asked her questions about sexual preferences — or acts like pegging — she realized that “beyond not being educated, not everybody is as curious or has access to the things that I did and maybe I’m someone that they feel comfortable [approaching].”

This willingness to educate fans about sex often stems from the performers themselves who experienced subpar sex education — if they received any at all.

“I’d have to say the biggest downside to young people using porn to learn things would probably be the fact that they just don’t learn about the personal side of it,” Huntsman shared. “I feel like porn is very separate [from] emotions.”

“And a lot of the times in porn, it’s all about the lust and about random hookups,” Huntsman continued. “It’s not about creating an actual bond.”

In addition to discussing the inherent problems of using adult as a source of sex education, “Who’s Your Teacher” points out that mainstream and conservative approaches to sex education (or lack thereof) often do not work.

As performer, producer and educator Nina Hartley explained, “the most detrimental thing about continuing on the path now in regards to sex education is that it’s not working. It is not reducing violence. It is not reducing unintended pregnancy. It is not reducing STIs. It is not reducing trauma. It’s not reducing ignorance. It’s not reducing isolation. It’s not reducing alienation. It’s not reducing self-loathing.”

Suggested Solutions

Baker firmly believes that sex education should be reframed as “Human Relations” and taught to children at the start of their formal schooling. “Everyone’s afraid of the word ‘sex,’” Baker stated, so “take it out of the equation, call it ‘Human Relations’ and start it in kindergarten.”

This is an idea that Hartley fully supports.

“I love the idea of rebranding Sex-Ed as Human Relations because Sex-Ed makes it all about genitals,” Hartley said. “And genitals are the least of it, they’re the last of it. All the things we can do with the bedroom are a deck of 52 cards; let’s take out the two most dangerous: a penis in a vagina and a penis in an anus, and put those cards [away]. Now we have 50 cards of things we can do that don’t result in death and babies and stressing you out for finals.”

Baker noted Hartley is also unique in that she has a history of weaving facts into the movies she makes. “It’s like putting spinach in your brownies, I was always putting sex-ed in my movies,” she said.

For the documentary, Baker also interviewed Lynda Nguyen, who is the founder of the sex education nonprofit the Magic of Psalm. The organization was created to develop a curriculum for young people to better understand their bodies and emotions as well as concepts such as boundaries and consent, a curriculum that is already being deployed in some schools. Nguyen describes the content that was created as “not only comprehensive and medically accurate, but also restorative because we’re not judging or shaming.”

Though Nguyen does not specifically mention the impact porn has had on sex-ed, she echoes the proposed solutions from Hart, Baker and others, particularly that sex-ed needs to be more than just a shallow overview of intercourse but should be medically accurate and endeavor to place sex in the context of understanding of one’s own emotional health.

84-Year-Old 'Senior Judge' Assigned to Civil Case Against MindGeek

LOS ANGELES — The judge assigned to preside over the beginning of the massive civil lawsuit against MindGeek, which will hinge on complex issues of third-party uploaded content on online platforms, Section 230 liability and internet moderation, is 84-year-old Consuelo Bland Marshall, appointed by Jimmy Carter in 1980.

Judge Marshall graduated from law school in 1961, was an active judge for 25 years between 1980 and 2005, and assumed “senior status” in 2005.

Senior Judges are occasionally called back from this form of “semi-retirement” to hear cases.

The assignment to the MindGeek case, which involves complex internet moderation matters and situations that occurred after Judge Marshall became a “senior judge,” was posted today on legal information site PACER.
