Colombian Performer Esperanza Gómez Files Constitutional Appeal Over Instagram Deletions

BOGOTA, Colombia — Colombian adult performer Esperanza Gómez has filed an appeal with Colombia’s Constitutional Court against the local subsidiaries of Instagram and Facebook, over the repeated deactivation of her accounts.

Colombian weekly Semana reported today that the Constitutional Court has agreed to review Gómez’s case to evaluate her claim that her constitutional “right to work” has been violated by the social media giants and their often arbitrary moderation policies.

Gómez has repeatedly complained about Instagram suspensions over her content, and while her account has reportedly been reinstated following gaps of several months, she said she still chose to obtain a preemptive court order to protect her labor rights in the future.

Her filing alleges that the deactivation of her accounts has affected her right to work because without social media she is unable to promote either her own work or the products of third-party sponsors, both crucial to her livelihood.

In 2018, the prominent Latin American adult performer reported that she lost at least three different Instagram accounts. Her current account — which she recovered after a dispute — has over 400,000 followers.

Her complaint against Instagram Colombia and Facebook Colombia S.A. is being reviewed by Constitutional Court Judge Natalia Ángel, after two lower courts rejected Gómez’s action. The Constitutional Court will consider the appeal on “right to work” grounds.

The case could set a precedent in a country that boasts a large number of cam performers and where sex worker rights are generally unregulated.

I am so happy the response has been so great. It feels good to have success in the art community the same week I have success in the porn industry.”

The July issue of Eerie Eclipse also includes a multi-page photo spread featuring Vendetta as a model, photographed by Carin Teresa Photography.

Utah Board of Education Adopts Guidelines for How to Ban 'Pornographic' Material

SALT LAKE CITY — The Utah State Board of Education has approved official guidelines for how to ban books and other material from school libraries, amidst a moral panic stoked by religiously inspired activists seeking to cleanse education of “pornography.”

The policy, local radio station KSL News explained, was created in response to new state law H.B. 374, which “gives direction to school districts and charter schools for reviewing potentially sensitive materials,” after the Utah attorney general’s office “gave not one, but two memos to USBE on how that law should be interpreted.”

Making things even more unclear for library staff, Utah school districts can choose whether or not to adopt the guidelines and implement book censorship reviews.

A key point repeatedly raised by conservative school board members was that they wanted to “keep books off shelves while they’re under review,” KSL News noted.

Under the guidelines adopted yesterday, concerned individuals can fill out a form challenging books they deem “questionable.” The concerned individual, however, “has to be a parent of a student that attends the school, a student who attends the school or an employee of the school.”

Each challenge will result in the formation of a “review committee” to evaluate whether “on the whole” the work “has serious literary, artistic, political or scientific value for minors.”

To appeal a book banned by these committees, the appellant must prove that “a district or charter school did not follow their outlined library policy and/or Utah law during the review process.”

Although USBE approved pulling books from shelves while they are under review, it did provide that such books “can still be accessed with parental permission,” prompting religious conservative activist and board member Natalie Cline to demand that challenged books be “pulled until the review process was complete.”

Cline claimed that “the way it is written, we are actually giving kids access to pornography in a restricted fashion, either by parental permission or by a digital access code. It violates H.B. 374. Our schools aren’t allowed to give students access to alcohol or drugs even with parental permission.”

Additionally, PASS has partnered with the Los Angeles LGBT Center to offer a vaccine clinic for sex workers on Friday, Aug. 5, in West Hollywood.

“While we are not aware of monkeypox incidents related to adult production, we are a community that has historically taken our health, and public health, very seriously,” said Ian O’Brien, executive director of PASS. “We have been working directly with stakeholders since we first became aware of the potential threat. The new guidance and clinic will help us prevent the spread, and we ask our entire community to join the fight.”

While much of the reporting on monkeypox has suggested sexual transmission between men who have sex with men, monkeypox is most often transmitted by direct skin contact, and through non-sexual activities such as kissing.

“This is a painful infection that is easily transmissible for those in physical contact with others,” says O’Brien. “The best thing you can do is get vaccinated, though we know vaccines are not accessible to everyone yet. In the meantime, to protect yourself and your community, be aware of any potential signs of infection in yourself or others, including unexplained muscle aches, chills, exhaustion and swollen lymph nodes that can precede a rash or lesion.”

The new PASS guidelines were developed in consultation with public health and medical experts:

  • If you develop any sort of suspicious rash, lesions, or bumps, or “feel sick,” do not work. Visit your medical provider immediately.
  • Reduce physical contact between people as much as possible.
  • Clean and disinfect surfaces, bedding and clothing. Utilize gloves and other personal protective equipment when cleaning.
  • Get vaccinated. If you are not in Los Angeles, check with your local public health agency to see if vaccination is available in your area.

The monkeypox virus (MPXV) is an orthopox virus that causes painful lesions on the body. As of today, there have been over 17,000 confirmed cases of monkeypox globally. In addition to a rash, symptoms include fever, unexplained muscle aches, chills, exhaustion and swollen lymph nodes. Monkeypox is transmitted via direct contact with lesions, body fluids and large respiratory droplets from an infected person. The virus can be transmitted from the time symptoms start until the rash has fully healed and a fresh layer of skin has formed, which may take several weeks. Monkeypox can be treated with antivirals that may help reduce symptoms. 

Testing & Prevention

There is no test available that screens for monkeypox unless a rash or lesions are present; as such, we cannot use testing as a way to prevent transmission on set. We encourage production to keep up health screening questions (per COVID), and be extra-diligent with cleaning protocols.

Vaccination

Vaccination is available for monkeypox and PASS encourages everyone who is able to get vaccinated to do so. However, the current supply is very limited, and public health departments are limiting access for folks at the highest risk, and many locations are referral-only. Monkeypox Exposures

If you have a known exposure to monkeypox, call a doctor immediately or reach out to PASS for further guidance. If a vaccine is administered within four days of exposure, as post-exposure prophylaxis (PEP), it may prevent you from contracting the infection or lessen the severity if an infection does occur. 

People who have contracted monkeypox should minimize potential contact with other people until their symptoms resolve, the rash heals and a new layer of skin forms. The CDC has also provided guidance on how to disinfect your home.

Defense Psych Expert: Ron Jeremy Not Competent to Stand Trial

LOS ANGELES — A psychiatric expert for the defense has issued a report asserting that Ron Jeremy is not competent to stand trial in Los Angeles for multiple sexual assaults and rapes.

According to sources familiar with the case, the expert issued the report yesterday, and it was presented in court today.

The case has now been postponed until Oct. 3.

The expert was hired by Jeremy’s attorney, Stuart Goldfarb. The Los Angeles County district attorney’s office has also hired its own psych expert, who will produce another report assessing Jeremy’s competency.

The criminal case has been at a standstill since presiding Judge George Lomeli’s March 17 decision to suspend proceedings after he received reports from Goldfarb and the bailiff that the defendant was “incoherent” and could not be transported to court.

As XBIZ reported, Judge Lomeli then referred the case to a mental health courthouse for a decision on Jeremy’s ability to stand trial. The judge recommended that psychiatrists on each side conduct evaluations to determine competency.

Jeremy is currently awaiting trial in Los Angeles, where he has remained in jail following his arrest in June 2020.

After an Aug. 2021 grand jury indictment was returned, Jeremy pled not guilty to 12 counts of forcible rape, seven counts of forcible oral copulation, six counts of sexual battery by restraint, four counts of sexual penetration by a foreign object, two counts of sexual penetration of an unconscious or asleep person and one count each of lewd act upon a child under the age of 14 or 15, sodomy by use of force and assault with intent to commit rape.

DUBLIN — Ireland’s Justice Minister Helen McEntee today declared that she believes pornography has become “too easily accessible” and “more violent and degrading.” She made the remarks in response to a survey publicized by the local mainstream press, claiming that “one in five men in Ireland aged under 55 watch porn daily.”

In a statement to the Irish Examiner, McEntee — a member of the right-leaning Christian Democrat Fine Gael party, a governing partner in a coalition led by Ireland’s Labour Party — reacted to the survey conducted by local nonprofit Men’s Development Network.

“Pornography is too easily accessible, it has become more violent and degrading,” McEntee stated. “It has changed the way younger people view sexual relationships. Men and boys can become agents of change by challenging discrimination, sexism and violence, and I welcome the tireless work that Men’s Development Network does in this area.

“I am glad that my department has been of assistance this year by providing funding for its awareness-raising campaigns. I’m confident that, through continued education, we can support men and boys, and women and girls, to fulfill their aspirations, unconstrained by narrow stereotypes. We must continue to work together.”

The MDN survey reports that more than 70% of men under 45 who responded to the survey reported “using porn” at least once a week, while over 40% of respondents aged 44 and under said that “pornography has influenced their expectations of sex in real life.”

While MDN’s website describes the survey as “Open to all men throughout the island of Ireland aged 18 upwards” and “seeking a representative demographic sample,” it is unclear based on mainstream news reporting whether MDN surveyed only straight-identifying cisgender men, or included queer and trans men. Most of the quotes used in press coverage conflate “men” with “cis straight men” and imply that “pornography” is only “used” by them.

MDN CEO Sean Cooke expressed hope that more people would “complete our Male Attitudinal Survey, to support us so we can continue to inform policy in ways that bring about meaningful societal change for us all.”

Ireland is currently undergoing a debate over sex education in schools. Whether porn awareness will be part of the curriculum, and how, has been a contested issue.

UK Activist to Fellow Radical Feminists: ‘Less TERF, More SWERF’

LONDON — U.K. lawyer, activist and cultural commentator Charlotte Proudman penned an opinion piece for The Independent newspaper today, urging fellow radical feminists to disavow transphobia and instead renew the campaign against “pornography,” following the lead of SWERF icons Catharine MacKinnon and Andrea Dworkin.

Proudman wrote today that “being a radical feminist means being a trans ally at the same time.”

Last November, she tweeted, “Sex work. It’s not sex because it’s not mutual & wanted. It’s not work when there’s a risk of rape and there’s no dignity. We need @nordicmodelnow.”

Her op-ed for The Independent appears to be a response to radical feminists in the U.K. and U.S. who espouse both TERF and SWERF positions, which are widely condemned by trans rights and sex worker rights activists.

But while Proudman would like her fellow radical feminists to stop targeting, stigmatizing and endangering the lives of trans women, she also continues to promote measures like the “Nordic Model” of sex work, which prevents sex workers from earning a living by criminalizing their customers.

Although such positions are antagonistic to sex workers and therefore appear to place Proudman in the SWERF camp, her essay does take issue with TERFs. It begins, “I hate the term TERF: trans-exclusionary radical feminism. Radical feminism has been co-opted by a few powerful transphobes who do not represent radical feminist ideology. As a result, many of the students I taught at Cambridge were anti-radical feminists. They believed radical feminism was inherently transphobic. But it isn’t.”

Proudman then states, “I align myself with radical feminism and am trans-inclusionary (let’s use RFTI, shall we?).”

Bringing Out the SWERF Icon Big Guns

According to Proudman, the proof that “radical feminism upholds the rights of trans people,” is the work “the OGs of radical feminism: legal scholar professor Catharine MacKinnon and the late author, Andrea Dworkin. Both trans allies. We need to remember this, and reclaim radical feminism for all women and oppressed groups.”

Both cis women and trans women, Proudman argues, “are harmed under the patriarchy and their unique experiences must be included in our feminism. There are very many trans women who live their feminist politics loud and proud every day: opposing the exploitation of sex workers, violent and degrading pornography, and all forms of male violence against women and girls.”

Trans Women Sex Workers as Automatic Victims in SWERF Doctrine

One of the main arguments Proudman presents to convince her fellow radical feminists to support trans women is that some trans women are sex workers, which she seems to believe automatically makes them victims.

“As early as 1983, Dworkin and MacKinnon both recognized the objectification and violation of trans people in pornography,” Proudman writes. “As such, their anti-pornography civil rights ordinance, which allowed women harmed by pornography to claim damages through the civil courts, also included trans people.”

By “pitting trans people against cis women,” Proudman concludes, “the patriarchy’s work is being done for those who uphold it. They’re making us fight amongst ourselves over scraps, when we should come together in solidarity and demand real rights — or revolution.”

GirlsDoPorn Owner’s Main Associate Matthew Wolfe Pleads Guilty

SAN DIEGO, Calif. — Matthew Wolfe, the second-in-command for the shuttered GirlsDoPorn website, pleaded guilty in San Diego federal court today to a single count of conspiracy to commit sex trafficking.

The 40-year-old Wolfe “admitted to his role in the broad scheme that recruited numerous women under false pretenses for pornography,” the San Diego Union Tribune reported today.

Wolfe’s responsibilities, according to the report, included “running the day-to-day operations of the websites, managing the finances, marketing the content and serving as cameraman for about 100 videos.”

He was the main business associate of GDP owner Michael Pratt, the New Zealand national who escaped the U.S. before federal charges against the company and its employees were unsealed in 2019.

Pratt remains a fugitive and is one of the FBI’s most wanted criminals.

The conspiracy count to which Wolfe pleaded guilty today, the San Diego Union Tribute reported, concerns 15 of-age models for the website.

The PornWikileaks Connection

Wolfe, the San Diego newspaper noted, admitted as part of his plea that “he was aware that the names and social media accounts for some women were posted on another website controlled by Pratt, resulting in severe harassment of the women by internet trolls. Still, Wolfe and others continued to assure recruits that their videos, and identifies, would remain secret.”

As XBIZ reported, during the 2019 civil trial of Pratt, Wolfe and other GDP associates in a case brought by a number of models, the plaintiffs’ lawyers alleged that in July 2015, “Defendants began publishing their victims’ personal information (names, links to social media accounts, hometowns, pictures, etc.) en masse to a website called PornWikileaks.com.”

Moreover, the Jane Does alleged that in November 2015, the domain PornWikileaks.com — the infamous website that hosted a doxxing and extortion fodder forum targeting adult models, called “Whore Hunting” — was transferred to an email address belonging to Michael Pratt.

In the Fall of 2019, during the civil trial but before the Department of Justice had unsealed the criminal charges and arrested Wolfe and others, it was revealed that Florida-based gonzo adult studio Bang Bros had bought PornWikileaks and “destroyed their servers” as a service to the adult community.

An FBI agent’s affidavit in the criminal case referred to PornWikileaks as “a website connected to Pratt.”

Wolfe also admitted as part of his plea agreement that “some of the women were threatened if they asked to stop,” the San Diego Union Tribune reported.

Owner Michael Pratt Still at Large

Wolfe faced a sentence of up to life in prison, but as part of his plea agreement, prosecutors are recommending his sentence should not exceed 12.5 years.

The January 2019 federal indictment named Pratt, male talent and scout Ruben Andre “Dre” Garcia, Wolfe and three others as co-conspirators in the GDP operation.

In June 2021, Garcia was sentenced to 20 years after pleading guilty in December 2020 to the charges of conspiracy to commit sex trafficking by force, fraud and coercion; and sex trafficking by force, fraud and coercion.

Pratt has been a fugitive from U.S. federal authorities since late 2019 and was last presumed to be in his native New Zealand two years ago.

While Pratt’s whereabouts are still unknown, San Diego FBI spokesperson Special Agent William McNamara stated that “we know there are people that are helping Pratt.”

In October 2021, the FBI increased the reward offered for information leading to Pratt’s arrest to $50,000.
